Terms Of Service
This bloggers’ agreement (“Agreement”) between Rob Port, sayanythingblog.com, its editors and agents (“Say Anything”), and web loggers (“Bloggers”)
Blogger is at least 18 years of age.
Blogger acknowledges that their account or login privileges may be terminated at the sole discretion of Say Anything for any reason or no reason at all, and that this Agreement does not constitute an employment agreement or any other obligation toward Blogger.
Blogger acknowledges that their posts and profile and their content may be edited, modified, or removed.
Blogger agrees not to post any copyrighted material, or does not meet ‘fair use’ standards.
Blogger will immediately forward any notices of copyright infringement, or any other notices of potential claims or liabilities relating to Say Anything.
Blogger agrees to indemnify, defend, and hold harmless Say Anything, its agents, editors, employees and fellow bloggers from and against any and all claims, actions, demands, liabilities, costs and expenses, including, without limitation, reasonable attorneys’ fees, resulting from your breach of any provision of this Agreement or any warranty you provide herein, or otherwise arising in any way out of your use of this Website. Say Anything reserves the right to take exclusive control and defense of any such claim otherwise subject to indemnification by you, in which event you will cooperate fully with Say Anything in asserting any available defenses.
SAY ANYTHING DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES AND CONDITIONS INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
This Agreement is governed by the laws of the State of North Dakota. The exclusive forum for any actions related to this Agreement shall be in Ward County, North Dakota, and, to the extent that federal courts have exclusive jurisdiction, in Minot, North Dakota. The parties consent to such venue and jurisdiction and waive any right to a trial by jury. Blogger is responsible for any and all attorneys’ fees, costs, or expenses of any claim or action arising out of this Agreement.
