DOJ Sues Wal-Mart For Not Rehiring Air Force Veteran

The Department of Justice filed suit again
st Wal-Mart Stores Inc. (WMT) for allegedly violating the Uniformed Services Employment and Reemployment Rights Act of 1994.

A representative for Wal-Mart couldn’t be reached for immediate comment.

The government alleges the Bentonville, Ark., retail chain violated USERRA by failing and refusing to reinstate Air Force airman Sean Thornton to his position of cashier at a Florida outlet after he was discharged by the Air Force.

The employment act requires that individuals who leave their jobs to serve in the military be reemployed by their civilian employers in the same position had they not left to serve.

Shares of Wal-Mart fell 43 cents to $52.25 in recent after-hours trading.

Maybe Walmart didn’t want to rehire him because he was a baby killer fighting in Chimpy McHitlerburton’s illegal war for oil.  Maybe Walmart thinks that any idiot dumb enough to get duped into this pro-Patriotic idiocy is some hick from the sticks and not worthy of working for them.

Consistent with a string of recent verdicts against huge retailers, Target Corp. was hit with a $1 million verdict, including $900,000 in punitive damages, on claims they violated federal law and state common law requiring reinstatement of service men and women following tours of duty.

The Oregon National Guardsman returned to his job at Target following two weeks of active duty only to find that he had been demoted. He complained via email to other Target employees and then attempted to enlist the help of the National Guard to have his position restored. Shortly thereafter he was fired because Target claimed his email to other employees was disruptive.

Because only Walmart is evil.

rbb is ass-uming that one decision by one store not to rehire or reinstate one employee is somehow statistically significant, or somehow representative of the world’s largest retailer* across the board.

rbb’s penchant to overinflate minor facts and exaggerate the importance of minor stories is all he’s got!

The Department of Justice has filed a class-action lawsuit accusing American Airlines, Inc. of violating the Uniformed Services Employment and Reemployment Rights Act of 1994 (USERRA).

The lawsuit represents the first class action complaint filed by the United States under USERRA.

The complaint, filed in the U.S. District Court in Dallas, Texas, alleges that American Airlines violated USERRA by denying pilots Mark Woodall, Michael McMahon, and Paul Madson employment benefits during their military service.

The complaint alleges that American Airlines conducted an audit of the leave taken for military service by American Airline pilots in 2001. The complaint further alleges that based on the results of that audit, American Airlines reduced the employment benefits of those of its pilots who had taken military leave , while not reducing the same benefits of those of its pilots who had taken similar types of non-military leave.

Woodall and McMahon serve as pilots in the Naval Reserve and hold the ranks of Captain and Commander, respectively. Madson serves as a pilot in the South Dakota Air National Guard and holds the rank of Lieutenant Colonel.

Bridgestone/Firestone North American Tire has agreed to settle a Justice Department lawsuit alleging the company violated the Uniformed Services Employment and Re-employment Rights Act of 1994 by failing to advance a returning member of the Army National Guard on its progressive pay schedule while the guardsman was serving on active military duty.

To the settle the lawsuit, the company agreed to advance the guardsman on its progressive pay schedule and pay him lost earnings, plus interest. In settling the lawsuit, the company denied any wrongdoing.

The complaint alleged that Bridgestone failed to advance the guardsman on its progressive pay schedule during a period of approximately 15 months while the guardsman was serving on active military duty.

There are several thousand of these lawsuits that happen each year over this.  We have no idea what motivated Walmart to fire said employee, but one must assume that it is not some systemic problem where Walmart routinely tries to fire all Military Vets.

We are talking about someone that Walmart didn’t want back as a cashier, not some high level executive.

I found a Wal-Mart story and I posted it.

Based on little evidence, little fact and you drew a conclusion way out of proportion to the facts. (Typical rbb bullshit!) Who’s the one pulling stuff out of their ass????

There was only one guy in the story. And he probably has a legitimate beef. It’s the asshole who draws the conclusion from that solitary instance that Wal-Mart hates America that is so repugnant to thinking individuals!

We have no idea what motivated Walmart to fire said employee, but one must assume that it is not some systemic problem where Walmart routinely tries to fire all Military Vets.

I will repeat myself.  No company in their right mind sets out to systemically fire military vets.  And the law is written so generically that it leaves little room for employers to ever fire a returning vet.  It should seem rather obvious that there were additional factors at play.

What also seems obvious is that the manager involved who fired the employee was not aware of the law’s provisions.  This is a shame on many levels.  First, the employee is probably going to win a financial settlement that is far more expensive than simply retaining a cashier.  Second, this is a bad PR move for the corporation made by some jackass store manager.  Third, once a manager fires or does not hire an employee, most HR folks defer to the manager’s judgement so as not to undermine their position.

Given that all RBB has seen of the lawsuit is a simple press release, I would give it a little more time for Walmart to defend themselves.  The DOJ, EEOC, and most other government organizations are filled with employees that want to make a name for themselves by being party to lawsuits against major corporations like Walmart and getting big damage claims.  Lawyers that win one big case, often leave to establish their own practice and use that case as a resume builder.  Don’t ever assume that none of them have motivation to throw shit at the wall and see what sticks since if they lose, it does nothing to their career, but if they win a suit against Walmart, they can use it to build a lucrative private practice.
