The Texas Cult Raid Takes A Bizarre New Twist

The State of Texas has dropped it’s warrant against Dale Barlow, 50, accused of raping minor girls at the fundamentalist Latter Day Saints ranch. Texas officials declined to say why the warrant for his arrest was dropped.

Rob Parker, speaking for the FLDS, said,
I think thats just one more piece of evidence that the whole basis on which this raid was premised was unfounded and was inadequately checked out, to the formulation of what basically amounted to an army that went in there and took their children.

pp, you didn’t post the best part of the article which implies that the arrest warrant was based on yet another anonymous phone call.

Authorities have not located the 16-year-old girl and are investigating the source of the call. 

The girl reported that she was a member of the Fundamentalist Church of Jesus Christ of Latter Day Saints and that she was beaten and raped at the sect’s Eldorado ranch.

The phone number used to call the crisis center is the same one once used by a Colorado woman, identified as 33-year-old Rozita Swinton of Colorado Springs, accused of making previous false reports of abuse.

Investigators have not said whether Swinton made the call to Texas authorities, though Vinger said she is “still considered a person of interest.”

docdave:  You are right, I didn’t. I debated how long to make my post and felt that it was not my place to rewrite the whole original article.

Your observation, however, is exactly correct, and demonstrates that, unlike some others here, you actually take the time to read the whole story.

This is what I’ve said would happen from the start in several articles.

The whole thing was botched from the beginning and completely ignored the Fourth Amendment. My argument has been that any evidence gathered under false pretenses or as a result of false pretenses cannot be used - it’s called the “Fruit of the Poisonous Tree” concept.

More of this case will crumble under their feet because of their rush to judgement.

I love being right.

Janet Reno indeed.  Yet another woman.  I wonder what is wrong with them?  Were they jilted at an early age?

So why are the authorities still trying to ‘cover up’ (I know you hate that word; you prefer ‘damage control’?) this misadventure, pil?  Fear of lawsuits, perhaps?  Or just nanny government not wanting to admit they screwed up?

At this stage I’m not really sure they’re trying to cover up anything. I think they’re scrambling to find someway to salvage their cases and the pucker factor is high, especially among the decision makers who jumped too soon.

They no doubt had headlines twinkling in their eyes - especially the local prosecutors, who probably saw this as a step to a political career - and it obscured their vision.

They still might make some cases out of this - if they’re lucky. The best they can hope for is a thing called “imminent discovery”. That means that even if you were there for another, more limited purpose, if you find something outside the scope of your warrant it’s still good because you’d have found it anyway had you hasd the proper warrant.

But even that will be a stretch because it is incumbent upon authorities to verify a call before acting on it, To not do so - and here’s another of those terms - can be called “deliberate indifference”. Their search and seizure was based on false pretenses. Not good.
