I should note that I have never once defended the polygamists.  I stated that implicitly in the post you linked, Sparkie.  I do, however, have a problem with Sheriff’s Departments owning tanks.

That’s an issue that’s mutually exclusive from the polygamist issue.

That the Palestinians chose Hamas in their election only goes to show that the people themselves are the enemy. The election, as flawed as it was, cleared up a lot of things for the world. then we should recognize them as a state and proceed accordingly. anyone with half a brain knows that the things rob has called ‘democracy’ are more than democracy. nonetheless, they are key to a stable state. we cannot expect fledgling democracies to understand that. we must respect their decisions. the small arms shipments to fatah that Bush and Condi have organized are undemocratic. ie. they did so without the approval of our elected congress. an act in the name of our country that is not an act of our country is inherently undemocratic. especially when it is aimed at unseating a group that was elected in an election we forced on these people. if we have a problem with the state of palestine, as lik intimes we should, then perhaps we can get our own population, or conversely, china or russia to vote to do something about it. oh, wait. europe probably won’t even support it. you rally for democracy in the ME, reap what you sow.

It seems to me that the authorities could have used their resources (other than the APC) to make a case about the alleged child abuse, obtained statements identifying the perpetrators, got a warrant and gone in and served arrest and search warrants and removed the offenders. about these putative child rapists. one, we have laws in this country. if you don’t break them, then the judge will let you go. if you do break them, then he won’t. some police are hasty and silly. we all know that. nonetheless, they have one of the hardest jobs in this country. while it may be unreasonable that a cop, say, points a gun at you and makes you keep your hands on the wheel… that’s only because you know you don’t have a gun on you or that you aren’t about to pull it on the cop. the cop doesn’t know that. as i said above, if the law has been broken, the judge will sort it out. if you guys can’t wrap your mind around that, then too bad. its easier, nowadays, to get a dog removed for abuse than it is to get kids removed for abuse. just because someone isn’t old enough to consent for themself doesn’t mean that they can be abused and/or raped by those who are old enough. hitting your kids when they misbehave is totally different that this, so i would just like to pre-empt those comparasons.

This is not about child rape.  This is not about pedophilia.  The law in Utah states that the age of consent is 16, unless the person engaging in sexual relations is already married, then it is 18.  You understand that the law was carefully crafted to single out one particular group of people, plain and simple.  What we recognize is that the laws of every state differ.  So the mere presence of a child to a woman under 18 does not therefore indicate a crime. 

The burden of proof is that any one individual engaged in sexual relations specifically with another individual who was younger than the age of consent in the state where the relations happened.  So you have to prove age of the victim, time that it occurred, and the location.  We recognize that without those factors, one cannot possibly prove a crime occurred.

What we have going on is guilt simply by association.  Let’s assume that one particular family consists of a man and a wife, plus several spirit wives.  Again, there is no crime of polygamy unless these wives are all LEGALLY MARRIED to the husband.  Otherwise, they are simply cohabitants that engage in sexual relations with the man… think of a man that has an affair with his nanny.  That happens all the time, think Jude Law.  Not illegal.  Then let’s assume that all of the wives were over the age of consent.  Explain what crime they committed.  Take that one step further, assume that no domestic abuse or spousal abuse is occurring in their home. 

What you have advocated is removing their children at gunpoint simply because they belong to a religious group in which some of the member of the group MAY HAVE committed a crime.  The actions in Texas leave ALL OF THE PARENTS unable to present evidence on their OWN BEHALF because they are not treated as individual families.  Every single family there is grouped together and guilty by association with little or no legal recourse to get their children back.

When they start prosecuting people for crimes and start showing some evidence other than a 33 year old in Colorado claiming to be a 16 year old abuse victim, then get back to me.  We afford legal rights to all citizens.  I am not defending polygamy and am certainly not defending the taking of underage brides.  But I am defending the rights of all individuals to not have their children taken at gunpoint by police in APCs when there is nothing more than an allegation by an individual that was clearly lying.

The end justifies the means though.  That is what you are saying.  Lie, cheat or steal to go after criminals.  Deny them their rights.  Who needs fair trials. 

For someone that claims to be a Libertarian, you certainly do not hold consistent.

What if they weren’t forced?  What about the women who weren’t forced?  How many do you think are forced?

If one woman is forced, does that mean the family that lives down the street is somehow guilty because they live in the same town?

that is clearly what I am advocating. in a qualified manner. are you telling me that we should give up the apprehension of murder suspects on the logic that they only MAY HAVE committed a crime? bullshit. again i would stress the role of the courts and the ‘innocent until proven guilty’ meme. if the girl hasn’t been molested, raped, or abused then there will be no grounds to (continue to) remove her from the family (unless they make her live in a closet full of dogshit or some other analogue yet-to-be-discovered).
