California Says “NO” To Homeschooling

Judge orders homeschoolers into government education Court:

“Family’s religious beliefs ‘no evidence’ of 1st Amendment violation.”

A California court has ruled that several children in one homeschool family must be enrolled in a public school or “legally qualified” private school, and must attend, sending ripples of shock into the nation’s homeschooling advocates as the family reviews its options for appeal.

“We find no reason to strike down the Legislature’s evaluation of what constitutes an adequate education scheme sufficient to promote the ‘general diffusion of knowledge and intelligence,’” the court said in the case. “We agree … ‘the educational program of the State of California was designed to promote the general welfare of all the people and was not designed to accommodate the personal ideas of any individual in the field of education.’”

The words echo the ideas of officials from Germany, where homeschooling has been outlawed since 1938 under a law adopted when Adolf Hitler decided he wanted the state, and no one else, to control the minds of the nation’s youth.

The State of California and increasingly the entire United States is demanding absolute control over our childrens bodies and minds. Children are no longer legally under the control of their parents to help them grow in their belief systems, these poor children are the de facto wards of “The State.” Rob’s newest daughter must be surrendered to the control of “The State” as to most things in her life and her parents are only the financial backers of these “State” owned children and if they resist or they will face losing their daughter and/or criminal prosecution.

We see this in Europe, Canada and now at last it has come to this country. Make no mistake: (1) This is part and parcel of “The State’s” open hostility, not towards people of faith, but specifically to Christ and the Church. They would never oppose any education program advanced by Muslims. (2) This is a product of Liberal-Socialism which runs wild in Europe and is “progressively” gaining near absolute power over our lives in this country. (3) No one can seriously doubt that all the legislation and judicial decisions that have advanced this agenda have been produced in the socialist stew pots of The Democrat Party Coven Oven’s, and it is part and parcel of their program to avoid the pitfalls of the former Soviet Union and Cuba and impose a perfect Socialist Utopia upon America and thereby using the graves of our Founding’ Father’s for their personal outhouses, wherein they can dump all the vile anti-Democratic shit they have been holding in their twisted constipated intestines for many decades.

A few people will complain, mostly Christians, angry at the public schools being used to indoctrinate their children in secular atheism, liberalism, militant environmentalism and homosexual “how to” courses, but enough secular conservatives will join with the courts and our liberal legislators and these protests will be vain exercises. We have lost our children to “The State,” they will kill them in the womb, control their bodies and minds and if ill, they will forcefully euthanize them - all for the children of course!

as North Dakota home school family, don’t think issues like this are isolated to the West coast. Ask any home school family and North Dakota’s rules on home schooling are some of the most stringent in the US. What totally bothers me is when did the government decided they know what is best for our children?

* When they decided that your kid needed inocculations and floridation to attend school.
* When they decided that children could not pray or otherwise express their religious convictions in public.
* When they decided that your kid had to wear a helmit to ride his bike.
* When they decided that kids could not wear American flag symbols to school.
* When they decided that children didn’t need to know about George Washington, Thomas Jefferson and Abraham Lincoln, but needed to read “Johnny Has Two Dads”.
* When they decided your kid was equally guilty if he protected himself against a bully.
* When they decided that reciting The Pledge of Allegiance made some children uncumfortable.
* When they decided that federal nutrition standards were more important than your choices for your child’s diet.
* When they decided that you were abusive if you spanked your child. 
* When they decided that school sports had to be banned because someone had to lose.
* When they decided that your daughter could get an abortion without your knowledge or permission.
* When they decided that your kid would have to sit by himself if he brought a peanut-butter sandwich to school.

all of that and more. when it comes to home schooling that really bothers me. we are required to have a mentor teacher from the school district monitor our activities. here’s a snap shot of requirements

Required Subjects:
1. English language arts, including reading, composition, creative writing, English grammar, and spelling.
2. Mathematics.
3. Social studies, including the United States Constitution, and United States history, geography, and government.
4. Science, including agriculture.
5. Physical education.
6. Health, including physiology, hygiene, disease control, and the nature and effects of alcohol, tobacco, and narcotics.

the kicker is that if they have a ‘problem’ then it’s okay to home school…

Achievement test required in grades 4, 6, 8 and 10. A certified teacher must administer the test, and it must be given in the child’s learning environment or the public school at the option of the parent. In certain conditions the school will pay for the test and the administration. Results must be provided to the local public school superintendent or county superintendent of schools. If the child’s composite score falls below the 30th percentile, the child must be professionally evaluated for a potential learning problem by a multidisciplinary assessment team.

A parent may choose to operate their home school as a private school under certain conditions.

Any child with any developmental disability may be homeschooled.

Have a read at the actual case in question.

Scary shit.  Read the entire thing.  It goes beyond just this one individual case and applies to most of the home school co-ops where multiple families work together and form a cooperative school.

Now keep in mind that this is one single appeals court ruling by one group of judges that will no doubt be appealed.

What is important is that we recognize Federalism and allow California to run all the home schoolers out of the state just like they have run all the business people out of the state, just like they have run most of the upper middle class that are able to move and get out from under the tax burdens.  These are by and large good people and the state of Arizona will welcome them with open arms.  Come here, we offer the freedom to home school.  California can have our illegal immigrants that are fleeing our state because our employer sanctions laws and we will take their folks that want a quality education for their kids.  Yet another case of California’s Liberal system in action.

I am secular in my belief in how the government should operate.  I am Libertarian or as close to one as you can be.  I want to homeschool my oldest son because he is brilliant and rarely challenged in school.  I don’t want to indoctrinate him into some cult, but rather don’t want him in a classroom with 10 kids that don’t fucking speak English.  I cannot afford private school and the only real private schools are religious schools.  It is precisely because I don’t want him indoctrinated with someone else’s religious beliefs that I figure that I can enroll him in online courses from the local community college and accomplish more doing that than by sending him to learn English as a Second Language.  In Arizona and Utah, kids can still play sports, go to high school events, and so on at their respective high schools.

Try this shit on for size from California’s annual No Child Left Behind Tests:

Between spring 1999 and spring 2005, districts were required to administer the SABE/2 to Spanish-speaking English learners (ELs) in grades two through eleven who were enrolled in California public schools fewer than 12 months when the tests were administered. Districts had the option of testing Spanish-speaking English learners who were enrolled in a California public school 12 months or more when the tests were administered. The tests were administered between March 15 and May 14 of each year. Students in grades two through eleven were tested in Spanish reading and language, as well as mathematics in Spanish. Students in grades two through eight were also tested in Spanish spelling. Students were required to take the SABE/2 in addition to taking the required state achievement tests in English for their grades.

Here is what the results show:

For students administered the test as second graders, the average student math score is 69%.  For those tested as twelveth graders, that score drops to 31%.

These figures are directly from California’s testing website.  <a href="http://www.cde.ca.gov/ta/tg/sr/documents/yr06rel89summ.pdf">For junior in high school, only 35% score at proficient in English, 40% score proficient in Math, 28% in science, and 33% in history</blockquote>.

The numbers are closer to 20% in Los Angeles County and San Bernadino County.

I am hard pressed to believe that these parents can do much worse of a job, even beating their kids daily, keeping them locked in dog kennels, and feeding them only bread and water, than the drug and gang infested shithold of a public school system in California is doing.  Perhaps Child Welfare should start taking children away from these poorly performing schools and shitbag parents that came here illegally from Mexico and giving them to the state indoctrination camps that force them to learn to read, write, and speak English.

Take a look at the Census report from 2006 regarding Domestic Net Migration paterns.  California is second only to New York in domestic net outmigration.  That means that in 100,000 more US Citizens leave that state than move there.  Yet California continues to grow in population, despite the fact that each year, there are 100,000 fewer American citizens coming in than leaving.  That translates into 1M less citizen that want to move there are the end of each decade.

Add this to these figures about fertility rates showing that whites, blacks, and asians are having children at below the replacement rate:

As shown in Figure 2, Latinas have much higher fertility rates than other ethnic groups in California. As of 2005, the total fertility rate for Latinas in California was 2.9 children per woman, substantially higher than for Asians, African Americans, and whites, who all had fertility rates well below the replacement level of 2.1.

The reason why California is mandating it is because they need these kids in public schools so that they can learn to speak Spanish proficiently.

Justin B: Staying on topic is a serious problem at SAB. Folks look for any little thing they can pounce on, leading to an endless series of diversions, return to issues that were flayed alive on other posts or submit a series of insults for insult’s sake.

Some read and address the original post and the comments made about it, leading to real debate while others sieze the opportunity to grap center stage with their little “hey, look at me” antics.

Its the nature of the beast, but it can be frustrating, even meaningless.

This decision is an absolutely outrageous intrusion of the State into the rights of parents to raise their children as they deem best. The Longs are in compliance with the CA Ed. Code but these 3 appointed judges have arbitrarily read more into the language of the law then is actually there. Nowhere in the code does it state that a “private full-time day school” cannot be located within the parents’ home.

What I find truly scary is the judges’ assertion that the State gets to decide whether a family is homeschooling for “religious” reasons (protected by the 1st Amendment) as opposed to “philosophical” reasons (which they claim are not). Yikes!

Even if it is for religious reasons, so what? Sounds like a great reason to me for homeschooling. The state has no compelling interest in public schooling, only in making sure children have equal access to education. Public schools are too costly and ineffecient because they are monopolies and not subjected to competitive market forces, Someone else on another thread on the Front Page, suggested that Vouchers is the only correct answer, I would suggest simply deducting all such educational costs, whether in a private school or homeschooling is the right answer.

Scary stuff but let’s not loose sight of the fact that it’s just an appellate court ruling, for now anyways. California courts are infamous for making weird rulings especially the San Fran area court. This is of course, another attempt by liberal courts to legislate from the bench thus bypassing our constitution which they are supposed to abide by. My hope is that this ruling will be overturned by a higher court but I’m sure we haven’t heard the last on this subject.

On a side note my great state of Florida permits home schooled children to participate in sporting events of their designated public school. Heisman trophy winner Tim Teebo was one of the most highly recruited high school football players in the country and he was home schooled. If you listen to his acceptance speech at the Heisman ceremony anyone would have been amazed by Tim’s graceful and eloquent speech. Truly a product of decent parents who only want what’s best for the children.

What’s interesting to me is that somehow the case made it to the appellate level without the HSLDA getting involved.  Now there are some weird things about Kahleefornia (you’re shocked I’m sure), and that does include homeschooling--which traditionally falls into a part of private schooling law.  So in a manner of speaking, some might say “there is no legal homeschooling in Kahleefornia”, and in a strict, technical sense, they might be right.

However, the HSLDA has won a LOT of cases there on this very topic, cases that oddly do NOT show up in this court’s analysis.  I predict the HSLDA gets involved in this or the next case, and that LAUSD gets spanked, and HARD, in federal court.
