Anti-Noose Law

ALBANY, N.Y. (Oct. 22) - Because of situations involving nooses, the state Legislature Monday moved toward making it a felony to display the symbol of lynchings in the Old South in a threatening manner.

“We won’t tolerate this,” said Sen. Dean G. Skelos, a Long Island Republican who sponsored the measure that passed Monday in the Senate . “There is no place for racism and intimidation in America.”

The bill also covers etching, drawing or painting the symbol. He said that, as in the case of Nazi symbols and burning crosses, an intent to threaten or harass would be part of an anti-noose law

One has to wonder, but most likely only if you’re a Caucasian will you probably wonder, does this anti-racist law include Nazi symbols, Mexican Flags, defacing the Holy Bible and the such? Or, is it only racist when not being done to the white American?
In my opinion, this anti-racist law is being racist.

When has the Mexican flag been used to threaten or harrass?

Matt on October 23, 2007 at 10:33 am

When it’s flown above or in place of the USA flag.

I think you are mistaking being offended with being threatened or harrassed.  I can fly any flag any way I want on my property.  It’s my flag.

So some threats are felonies, and some are protected free speech.  Yes, Anna, this is bigotry about to be handed down from Albany.

And the bitter irony is that the impetus for the law is likely to be a noose hung by campus activists--it will have nothing more to do with the Klan or actual anti-black bigotry than Bill Cosby.

What ever happened to the sensible doctrine of “fighting words,” and the sensible fact that if you do something racially bigoted in public, you will face the rejection of your neighbors, friends, and colleagues?

Great. One more “intent” law that will further burden our courts with, “he was thinking this” crap.

This law has great implications against the First Amendment and I seriously doubt that it will pass a constitutional challenge.

I agree, but only I seriously hope it don’t.

Of course it will because it requires the person to use in a threatening or harrassing manner, which is already against the law.  This just makes it a felony.

Has the original law passed a constitutional challenge?

Not that anyone wants to be the person to take something like that to court, but I think it pretty clearly is a violation of free speech.

What possible crime could this law cover that isn’t already covered by another crime?  We already have laws about things like trespassing and harrassment.  Now we need a law specifically about nooses?

Sounds pointless to me.

Because White Americans are the only ones who care about the Holy Bible.  I should have noticed this earlier.  What does defacing the Holy Bible have to do with being a White American?  Your bias is showing.

The law in question requires the noose to be used in a threatening or harrassing manner.  The ones you saw were probably used for Halloween, and would not be covered under this law.

Huh??  How does one use a noose ‘in a threatening or harrassing manner’?  Unless of course it’s already tied around ones neck.

Actually, the “Holy Rollers” were/are Pentacostals, not Baptists.  Just FYI.

I love it when ninnies pick on ninnies. The noose law is foolish, but not as foolish as the idea that flying a Mexican flag is racist! Ha! Anna seems to imply that we might have laws regulating what flags we fly and yet she is opposed to the noose restricting laws! The kool aid up in Walla Walla must have some exceptional potency this time of year.

Sparkie Arbuckle: Don’t you think that flying a Mexican flag over our flag is a sign of aggression?

Not to long ago I remember an incident where a new family decided to hang a Puerto Rican flag outside of there house, it didn’t take long for there neighbors to notice. Within days afterwards there were American flags flying on every house within a four block radius. Within a week the Puerto Rican flag was taken down. Eventually the American flags began to disappear as well, or though many decided to keep them waving.

So what’s your verdict?

WETBACK on October 25, 2007 at 04:59 pm

Sparkie Arbuckle: Don’t you think that flying a Mexican flag over our flag is a sign of aggression?

Maybe it is to some people. Not ‘objectively’ though, no. And? Its a flag. People get so fucked up over flags - its amusing.

So what’s your verdict?

People are insecure. I don’t know. What should be the verdict? Y’all know ALL THE ANSWERS. If you have to fly your flag to display your patriotism or nationalism, that’s fine. I would rather run my mouth, challenge authority, and generally do errant, bizarre, and unpredictable things! Its my birthright, freedom! Wanna see my passport?

Problem is you get all these insecure fuckers who are caught up with dissenters and the lot like they aren’t the sole natural resource this country has. The government is in the bedroom! And so forth… I just wish the govvy would blow their wad buying us all nice, old model .38 specials and then bow out. John Wayne style. Once government begins, its just a slippery slope to Maoism. Just ask the ‘small government’ Republicans that are up in everyones mashed potatoes for the last few years.
