From the Joint Committee on Taxation letter(JCT) confirming that the failure to comply with the individual mandate to buy health insurance contained in the Pelosi health care bill (H.R. 3962, as amended) could land people in jail.

“H.R. 3962 provides that an individual (or a husband and wife in the case of a joint return) who does not, at any time during the taxable year, maintain acceptable health insurance coverage for himself or herself and each of his or her qualifying children is subject to an additional tax.”

Prosecution is authorized under the Code for a variety of offenses.  Depending on the level of the noncompliance, the following penalties could apply to an individual:

• Section 7201 – felony willful evasion is punishable by a fine of up to $250,000 and/or imprisonment of up to five years.” [page 3]

I realize this news item is a few weeks old but the relentless efforts of the Democrats to push Health Care Reform regardless of it’s popularity and it’s bankrupting certainty continues. I am sure they are hoping we will all get tired and weary of the fight against this massive government intrusion in our lives and just give up or go away. Not yet, so to follow up on Rob’s post yesterday ...Time To Melt The Phones: Senate Finance Committee To Vote On Obamacare Today it’s not over and I couldn’t get over how little coverage this preposterous IRS penalty known as the “Individual Mandate” had received in all of the media back in September.

Americans who fail to pay the penalty for not buying insurance would face legal action from the Internal Revenue Service, according to the Joint Committee on Taxation.

  The remarks Thursday from the committee’s chief of staff, Thomas Barthold, seems to further weaken President Barack Obama’s contention last week that the individual mandate penalty, which could go as high as $1,900, is not a tax increase.

  Under questioning from Sen. John Ensign (R-Nev.), Barthold said the IRS would “take you to court and undertake normal collection proceedings.”

  Ensign pursued the line of questioning because he said a lot of Americans don’t believe the Constitution allows the government to mandate the purchase of insurance.

  “We could be subjecting those very people who conscientiously, because they believe in the U.S. Constitution, we could be subjecting them to fines or the interpretation of a judge, all the way up to imprisonment,” Ensign said. “That seems to me to be a problem.”

  Ensign’s argument, however, wasn’t persuasive to the committee — which rejected an amendment from Sen. Jim Bunning (R-Ky.) to eliminate the individual mandate.

  Sen. Olympia Snowe (R-Maine) was the only Republican to vote with Democrats to preserve the mandate.

And in case you think this smells like fishy dis-information and needs to be reported to the nearest ACORN office, there was confirmation…

The “Code” in question is the Internal Revenue Code, and Barthold’s note was a followup to Ensign’s public interrogation of him on the issue of whether or not the IRS would be responsible for enforcing the “individual mandate” in President Barack Obama’s health care “reform” plan.
Apparently the answer is “yes.”

In case you missed it on Rush Limbaugh or Red County today: Our Attorney General, Reichsführer-SS Eric Holder, may well be breaking new ground in Justice Department unscrupulousness by hiring—viz., “paying with taxpayer dollars”—wackjob liberal bloggers to seek out and troll-poop on anti-Obama Administration media reports and blog posts.

  As reported at The Muffled Oar, a blog that first broke the story of Holder’s secretive blogging unit—dubbed the “Blog Squad” by blogger Isaac Muzzey—Holder has housed this unit in the Office of Public Affairs at the Department of Justice. It also appears that former John Edwards staffer Tracy Russo is part of this special unit.

From The Muffled Oar, who broke the story last Friday:

  Not only is the Department of Justice Blog Squad going to reach out to nontraditional media like TPM Muckraker or the Muffled Oar, but they are also tasked with fostering anonymous comments at conservative leaning blogs such as the Free Republic. They are also tasked with fostering anonymous comments, or comments under pseudonyms, at newspaper websites with stories critical of the Department of Justice, Holder and President Obama.

Does this sound legal to you, dear reader? I suppose it could be considered so, if, like Führer Obama, you simply consider taxpayer dollars as your own, to do with as you please - even hand out to screaming rioters. For more on the legal issues raised, see NRO’s the corner blog.

Clearly it’s time for an investigation. Of course, who could possibly do that? The Justice Department, with it’s unimpeachably incorruptible AG, could investigate itself. Or the Democrat Congress—the most transparent, hard-working, and ethical Congress in decades—could appoint a Special Prosecutor.

Either of these sound about as likely as Obama singing The Star-Spangled Banner from memory whilst pulling a rabbit out of Happy Joe Biden’s arse. Until then, dear reader, the writers at Moonbattery.com will continue to taunt the Blog Squad to no end.

To be sure there must be some legs tingling and twitching at this honest to goodness feel good story of the week.  We sure needed it after that “Copenhagen Smack Down” regarding the Olympics and Chicago last week, but let’s not get too carried away.  Barry’s never ending popularity campaign may have won him the equivalent of “Global Idol” this week but the stark reality of his do nothing presidency is glaring.

The Rasmussen Reports daily Presidential Tracking Poll for Tuesday shows that 30% of the nation’s voters Strongly Approve of the way that Barack Obama is performing his role as President. Thirty-seven percent (37%) Strongly Disapprove and that gives Obama a Presidential Approval Index rating of -7.  Overall, 51% of voters say they at least somewhat approve of the President’s performance. Forty-nine percent now (49%) disapprove.

Speaking of doing nothing, hell even SNL took an unusual swipe at Obama’s ineffectiveness this past weekend.

Unemployment Disaster:
The number of unemployed Americans is now at 9.8%, the highest level since 1983, that’s 26 years folks. So where did that Stimulus money go? Now, with only 2.4 million full-time permanent job openings and 15.1 million unemployed, job seekers outnumber openings six to one, the worst ratio since the government began tracking open positions in 2000. Obama promised his stimulus program would create 3 million new jobs but the economy needs 8 million Jobs just to get even and to get back to full employment, or below 5% unemployment, the economy would have to create 12 million to 14 million jobs.  http://www.moneymorning.com/2009/10/05/unemployment-rate-5/
Not such a rosy picture so now the Obama administration is talking up another “Stimulus” bamboozle.

And then there is Afghanistan and the President’s foot dragging and ‘half-ass it and hope’ approach that finally led to a brief twenty-five minute meeting with General Stanley McChystal aboard Air Force One, more of a photo opportunity than anything else. More American soldier casualties have occurred this year than in any previous year of the war http://icasualties.org/oef/ yet Obama needs more face time with political advisors.
House Armed Services Committee Chairman Ike Skelton (D-MO) put it as bluntly as possible to Obama in his letter September 22, 2009:

“I am convinced that there is no strategy short of a properly-resourced counter-insurgency campaign that is likely to provide lasting security. But, time is not on our side. Coming from Harry Truman country, I ask myself, ‘What would Harry Truman do?’  And this leads me to urge you to waste no time in providing a clear direction to our commanders and civilian leaders, along with the resources necessary to achieve their mission—and to do so with an understanding that the American and Afghan people, as well as our allies, must see progress in the next 12 months.”
• “The last administration allowed itself to be distracted from the fight forced on us in Afghanistan by the fight it chose in Iraq.  I believe that this was a strategic mistake, robbing the war in Afghanistan of the necessary resources and resulting in an approach of ‘half-ass it and hope.’  We cannot afford to continue that policy.”

Given the intensely and admirably egalitarian nature of the United States presidential election process, it has always been a theoretical possibility that the country will send to the White House a person inexperienced in global affairs and unequal to the international situation before him. Often this has not been the case, and incumbents have risen to the job. Sixty years ago, Harry S Truman had limited first-hand knowledge of great power bargaining but turned out to be farsighted enough to anticipate the Cold War. Mr Obama is the antithesis of this phenomenon. He is completely out of his depth and will probably leave behind a dangerous and unsure legacy. India could have done without this neophyte.

Not all of us have forgotten the lessons of Vietnam and the waffling by this president is done at great risk to our soldiers and to the rest of the world. God Bless our soldiers in harm’s way.

So while Obama just won another phony global popularity contest and the inept media tries to claim that Obama’s approval ratings are actually increasing…fact is it takes more than star power and perpetually running for senior class president to be the President of the United States…an idea somehow lost on Obama and his administration.

Cluless Zero: We Don’t Need No Stink’in Oil and Gas

Yet another important subject affecting our National Security that the Chairman hasn’t got a clue about. Nuclear Iran and North Korea are really such pesky annoyances to the Leader’s vision of change and he can’t be bothered with that too much, in his own words…no real threat there, they are but “tiny” countries. And when you dream as big as Zero does about wind farms and electric cars apparently so is Domestic Energy and National Security. Coal already has been branded as “killing us” by that energy expert Harry Reid so it’s only natural that the next message here is “No” to oil and gas, I mean we don’t really need that stuff do we?
Oh but wait…that’s right Zero just gave Brazil 2 Billion American greenbacks for their deep water offshore oil project.

Well good maybe we can increase our foreign oil importation to 72% there is obviously no problem in that. Progressive domestic energy initiatives forbid us from drilling just about everywhere on our mainland, Alaska and offshore. Yet the Chinese are planning to slant drill off the Cuban coast near the Florida Straits, tapping into U.S. oil reserves that are estimated at 4.6 billion to 9.3 billion barrels and refining it in Cuba. 
I guess if there is any pollution from that “environmental friendly” venture it will stay well away from the Florida coastline or the Gulf of Mexico. Now that Teddy is gone perhaps all those wind mills will be built off Cap Cod bringing all that electricity to the heartland. Bad news is how will this get done now that Van Jones won’t be there to coordinate it all?
Did someone say the Chairman had a plan for this country?

Obama Administration: US Has Over invested In Oil, Gas

The Obama administration opened a new front in its effort to impose $31.5 billion in taxes on oil and gas companies, saying that the nation puts too much emphasis on oil and gas at the expense of other industries.

The chief economist in the Obama administration’s Treasury Department testified before a Senate panel that current subsidies “lead to overinvestment” in the oil and gas industry. That went beyond previous statements about the need to protect taxpayers and was the clearest signal yet that the federal government hopes to end its role in nurturing domestic oil and gas production.

“To the extent that current subsidies for the oil and gas industry encourage the overproduction of oil and natural gas, they divert resources from other, potentially more efficient investments, and they are inconsistent with the Obama administration’s goals to reduce greenhouse-gas emissions and build a new, clean energy economy,” Alan Krueger, the Treasury’s chief economist, told the panel.

“That’s absurd,” said Devon Energy Corp. (DVN) Chief Executive Larry Nichols, the chairman of the American Petroleum Institute, before the panel. “At a time when respected energy studies agree on the need to increase all sources of domestic energy, it makes absolutely no sense to discourage production of our leading sources, oil and natural gas.”

For years, Republicans encouraged oil as part of an “all of the above” strategy intended to reduce reliance on imports, especially from unstable parts of the world. But the Obama administration is trying to shift the debate amid a focus on global warming. Oil is viewed by the Obama administration as part of the problem because transportation accounts for more than a quarter of U.S. greenhouse gas emissions.

The new rhetoric isn’t sitting well with Congress. Sen. Orrin Hatch, R-Utah, warned that the U.S. would be “at a tremendous disadvantage” if the country turned its back on oil, gas and coal. Jeff Bingaman, D-N.M., a moderate voice in the Democratic party, cited “concerns” about some of the proposals, urging sensitivity to regional interests. Sen. Jim Bunning, R-Ky., used stronger language.

“We are 62% imported from not very friendly countries right now on oil,” Bunning said. Krueger replied: “That’s correct. The best way for us to reduce”—but Bunning cut him off. “Is to become less independent—is that what you’re saying?” Bunning said.

The Obama administration also may run into inconsistencies as it shapes its own energy program. By taking away tax incentives for gas production, the U.S. would be discouraging a cleaner-burning fossil fuel that is seen by some environmentalists as central to transitioning away from coal.

“This counterproductive approach is also at odds with the administration’s own carbon reduction policy because it would discourage the production of natural gas, our cleanest fossil fuel,” said Nichols.

In the words of another energy expert and Speaker of the House Nancy Pelosi:

“I believe in natural gas as a clean, cheap alternative to fossil fuels,” she said at one point. Natural gas “is cheap, abundant and clean compared to fossil fuels,” she said at another.

Brilliant leadership…just brilliant.

ObamaCare is a Trojan Horse for Forced Unionization.

In the heated debates on health-care reform, not enough attention is being paid to the huge financial windfalls ObamaCare will dole out to unions—or to the provisions in the various bills in Congress that will help bring about the forced unionization of the health-care industry.

Tucked away in thousands of pages of complex new rules, regulations and mandates are special privileges and giveaways that could have devastating consequences for the health-care sector and the American economy at large.

The Senate version opens the door to implement forced unionization schemes pursued by former Govs. Rod Blagojevich of Illinois in 2005 and Gray Davis of California in 1999. Both men repaid tremendous political debts to Andy Stern and his Service Employees International Union (SEIU) by reclassifying state-reimbursed in-home health-care (and child-care) contractors as state employees—and forcing them to pay union dues.

Following this playbook, the Senate bill creates a “personal care attendants workforce advisory panel” that will likely impose union affiliation to qualify for a newly created “community living assistance services and support (class)” reimbursement plan.

The current House version of ObamaCare (H.R. 3200) goes much further. Section 225(A) grants Secretary of Health and Human Services Kathleen Sebelius tremendous discretionary authority to regulate health-care workers “under the public health insurance option.” Monopoly bargaining and compulsory union dues may quickly become a required standard resulting in potentially hundreds of thousands of doctors and nurses across the country being forced into unions.

Ms. Sebelius will be taking her marching orders from the numerous union officials who are guaranteed seats on the various federal panels (such as the personal care panel mentioned above) charged with recommending health-care policies. Big Labor will play a central role in directing federal health-care policy affecting hundreds of thousands of doctors, surgeons and nurses.

Consider Kaiser Permanente, the giant, managed-care organization that has since 1997 proudly touted its labor-management “partnership” in scores of workplaces. Union officials play an essentially co-equal role in running many Kaiser facilities. AFL-CIO President John Sweeney called the Kaiser plan “a framework for what every health care delivery system should do” at a July 24 health-care forum outside of Washington, D.C.

The House bill has a $10 billion provision to bail out insolvent union health-care plans. It also creates a lucrative professional-development grant program for health-care workers that effectively blackballs nonunion medical facilities from participation. The training funds in this program must be administered jointly with a labor organization—a scenario not unlike the U.S. Department of Labor’s grants for construction apprenticeship programs, which have turned into a cash cow for construction industry union officials on the order of hundreds of millions of dollars each year.

There’s more. Senate Finance Committee Chairman Max Baucus has suggested that the federal government could pay for health-care reform by taxing American workers’ existing health-care benefits—but he would exempt union-negotiated health-care plans. Under Mr. Baucus’s scheme, the government could impose costs of up to $20,000 per employee on nonunion businesses already struggling to afford health care plans.

Mr. Baucus’s proposal would give union officials another tool to pressure employers into turning over their employees to Big Labor. Rather than provide the lavish benefits required by Obamacare, employers could allow a union to come in and negotiate less costly benefits than would otherwise be required. Such plans could be continuously exempted.

Americans are unlikely to support granting unions more power than they already have in the health-care field. History shows union bosses could abuse their power to shut down medical facilities with sick-outs and strikes; force doctors, nurses and in-home care providers to abandon their patients; dictate terms and conditions of employment; and impose a failed, Detroit-style management model on the entire health-care field.

ObamaCare is a Trojan Horse for more forced unionization.

The Obama White House is behind a cynical, coldly calculated political effort to erase the meaning of the Sept. 11, 2001 terrorist attacks from the American psyche and convert Sept. 11 into a day of leftist celebration and statist idolatry.
This effort to reshape the American psyche has nothing to do with healing the nation and everything to do with easing the nation along in the ongoing radical transformation of America that President Obama promised during last year’s election campaign. The president signed into law a measure in April that designated Sept. 11 as a National Day of Service, but it’s not likely many lawmakers thought this meant that day was going to be turned into a celebration of ethanol, carbon emission controls, and radical community organizing.
The administration’s plans were outlined in an Aug. 11 White House-sponsored teleconference call run by Obama ally Lennox Yearwood, president of the Hip Hop Caucus, and Liv Havstad, the group’s senior vice president of strategic partnerships and programs.
Yearwood, who uses the honorific “Reverend” before his name, has been in the news in recent years, usually for getting arrested. After Democrats took back Congress, the rowdy activist was handcuffed outside a congressional hearing in September 2007 when Gen. David Petraeus was to testify. Yearwood told the “Democracy Now” radio program that he wanted to attend the hearing to hear Petraeus give his report. “I knew that when officers lie, soldiers die,” he said.
On the Aug. 11 call, Yearwood and other leaders kept saying repeatedly that they wanted 9/11 to be used for something “positive,” “forward-leaning,” and “productive,” said a source with knowledge of the teleconference.
The plan is to turn a “day of fear” that helps Republicans into a day of activism called the National Day of Service that helps the left. In other words, nihilistic liberals are planning to drain 9/11 of all meaning.
“They think it needs to be taken back from the right,” said the source. “They’re taking that day and they’re breaking it because it gives Republicans an advantage. To them, that day is a fearful day.”
A coalition including the unsavory left-wing pressure group Color of Change and about 60 far-left, environmentalist, labor, and corporate shakedown groups participated in the call. Groups on the call included: ACORN, AFL-CIO, Apollo Alliance, Community Action Partnership, Deep South Center for Environmental Justice, 80 Million Strong for Young American Jobs, Friends of the Earth, Joint Center for Political and Economic Studies, Mobilize.org, National Black Police Association, National Coalition on Black Civic Participation, National Council of Negro Women, National Wildlife Federation, RainbowPUSH Coalition, Urban League, and Young Democrats of America.
Color of Change is the extremist racial grievance group that isn’t happy that TV’s Glenn Beck did several news packages on Van Jones, the self-described “communist” and “rowdy black nationalist” who became the president’s green jobs czar after jumping on the environmentalist bandwagon. The White House may be behind a push to destroy Beck by convincing advertisers to stop buying time on his show. Jones was also on the board of the Apollo Alliance, a hard-left environmentalist group that is now running large chunks of the Obama administration. The group has acknowledged that it dictated parts of the February stimulus bill to Congress.
With the help of the Obama administration, the coalition is launching a public relations campaign under the radar of the mainstream media—which remains almost uniformly terrified of criticizing the nation’s first black president—to try to change 9/11 from a day of reflection and remembrance to a day of activism, food banks, and community gardens.
“The organizing term is to ‘go dark.’ You don’t tell the press, don’t tell people you think will tell the press,” said the source.
Of course, the annual commemoration of the 2001 terrorist attacks belongs to the entire nation, but President Obama and the activist left don’t see it that way. They view the nationwide remembrance of the murder of 3,000 Americans by Islamic totalitarians as an obstacle to winning over the hearts and minds of the American people.
“When you criticize them, they are prepared to say, ‘Did you want 9/11 to be another day of selling mattresses, like Presidents Day?” the source said. “They are truly trying to change the American mindset.”
They view Sept. 11 as a “Republican” day because it focuses the public on supposedly “Republican” issues like patriotism, national security, and terrorism. According to liberals, 9/11 was long ago hijacked by Republicans and their enablers and unfairly used to bludgeon helpless Democrats at election time.

MSNBC’s foremost left-wing bloviator, Keith Olbermann, summed up this ugly perspective the week after the Republican Party convention last year:
But 9/11 has become a brand name. A Republican campaign slogan. Propaganda of the lowest form. 9/11 has become 9/11 with a trademark logo. “9/11 TM” has sustained a president who long ago should have been dismissed, or impeached. It has kept him and his gang of financial and constitutional crooks in office without—literally—any visible means of support. “9/11 TM” has made possible the greatest sleight-of-hand in our nation’s history.
On Aug. 4, the White House offered a glimpse into its plans to desecrate 9/11 for political advantage. Jones appeared in a largely ignored 33-minute video posted on the official blog of the White House to discuss the administration’s plan to flush 9/11 down the memory hole just as it has tried to do by rechristening the Global War on Terror the “Overseas Contingency Operations.”
Of this National Day of Service, Jones says little except that it will be a great opportunity “for people to connect, to find other people in your peer group who are also passionate about repowering America but also greening up America and cleaning up America.”
On the same day, Housing and Urban Development Secretary Shaun Donovan, Environmental Protection Agency Administrator Lisa Jackson, and Department of Energy Under Secretary Kristina Johnson and activists held a low-key press conference. At it, Yearwood said the National Day of Service will be “the first milestone” of a larger effort called Green the Block that is attempting to convince Americans that the utopian fantasy of a so-called green economy is possible without turning the U.S. into a Third World country.
“From policy creation to community implementation, the Green the Block campaign wants to see access and opportunity created for all Americans, to build prosperity and a healthier planet for future generations,” Yearwood said.
At no time does anyone explain why this National Day of Service has to be held—of all the 365 days in a year—on Sept. 11.
