Trying KSM in Civilian Court: Inconsistent, Indefensible, Inexplicable

“George Washington, who presided over the Constitutional Convention, had been personally responsible as commander in chief of the Continental Army for overseeing and carrying out the sentences of military commissions that tried British spies during the American Revolution. In 1942, the Supreme Court took up the case of Ex Parte Quirin, which pondered whether President Franklin Roosevelt—our most left-wing president until now—could lawfully and constitutionally order that a group of Nazi saboteurs captured on U.S. soil be tried by military commissions.


The unanimous justices pointed to Article 1, Section 8, Clause 10, and noted that Congress in 1806 had passed a law that “imposed the death penalty on alien spies ‘according to the law and the usage of nations, by sentence of a general court martial.’” This 1806 law, they observed, was based on a prior law enacted by the Continental Congress on Aug. 21, 1776—hardly a month after approval of the Declaration of Independence.


That the Constitution intended for unlawful enemy combatants to be tried by military commissions and not by civilian courts, the justices concluded, “is a construction of the Constitution which has been followed since the founding of our government.”


For President Obama to take Khalid Sheik Mohammad, captured overseas and held on a military base in Cuba, and put him in a civilian court in New York City to undergo a trial using legal procedures designed for the prosecution of American civilians who have not committed war crimes, does not reinstate the traditional American understanding of justice, it radically departs from it.


Why would President Obama and his attorney general choose this course? What point are they trying to make?


In a May 21 speech at the National Archives, Obama himself said: “Military commissions have a history in the United States dating back to George Washington and the Revolutionary War. They are an appropriate venue for trying detainees for violations of the laws of war. They allow for the protection of sensitive sources and methods of intelligence-gathering; they allow for the safety and security of participants; and for the presentation of evidence gathered from the battlefield that cannot always be effectively presented in federal courts.”


Is it Obama’s argument now that Khalid Sheik Mohammad did not violate the laws of war? Is it Obama’s argument now that the United States does not need to protect sensitive sources and methods used in gathering intelligence on Mohammed and his al-Qaida affiliates? Is it Obama’s argument now that the participants in Mohammed’s trial will not need the safety and security provided by a military commission? Is it Obama’s argument now that the case against Mohammed does not involve evidence gathered on battlefields that cannot be effectively presented in federal courts?


The truth is Obama has no argument at all to justify trying this unlawful enemy combatant who perpetrated war crimes against America in a civilian court designed for civilian crimes.”

“Well, that was definitely a world-class bow in Tokyo. [Obama’s] apologists will say it was protocol or politeness, but I have looked at pictures of other presidents, vice presidents, and others, and they haven’t gone halfway to the emperor’s toes on a bow.

I have seen pictures of MacArthur with Hirohito and he never bowed — and MacArthur wasn’t even a president, although at times he thought he was.

But there was a second incident that I found interesting, when the president declared himself the First Pacific President. That’s because, presumably, he grew up and spent some of his childhood in Hawaii, and in Indonesia, and his mom took him on a visit to Japan, although all he remembers of that, as he says, was the ice cream.

The First Pacific President?

Well, Teddy Roosevelt — he built the Panama Canal in order to make the United States a Pacific power and he did. William Howard Taft, his successor, was the governor of the Philippines. And John Kennedy and George Bush Sr. were in the Pacific [theater] in the Second World War and spent some time in the Pacific Ocean itself — Bush, after having been shot down from his airplane; and Kennedy, after having his ship cut in half by a Japanese patrol boat.

So these people actually spend time in the Pacific, but in Obama’s mind, it doesn’t in any way match the experience of the baby Jesus — excuse me, the baby Obama — growing up on some Pacific island.

On the decision to try Khalid Sheikh Mohammed in a New York civilian court:

“What is so hard to understand is Holder’s argument, the logic of his argument.

Now, I want to look only at a single aspect of it. … If [Holder] opposed the military commissions on principle, you could say his decision on Khalid Sheikh Mohammed was wrong, but at least it was logical.

But he doesn’t. On the day he sent KSM to a civilian trial in New York, he announced he would send five of the miscreants who attacked the Cole, a warship, to a military trial in Guantanamo or perhaps elsewhere.

Now, what is the logic here? Holder was asked about this, and to the extent that he was coherent, which is only to a small extent, he said: Well, if you attack a civilian target, as in 9/11, then you go to a civilian court; a military target like the Cole, to a military [court].

First of all, the Pentagon was hit on 9/11, so it wasn’t exclusively a civilian attack. But perhaps Holder forgot about that.

But secondly, even if [9/11] were exclusively an attack on civilians — which is a worse act of war criminality, attacking defenseless civilians or attacking a military target, like a warship? We have attacked warships in our history, Japan and Germany and the Second World War and elsewhere. That is an accepted act of war.

Why does a person [like] Khalid Sheikh Mohammed, who attacked civilians — the more obvious and egregious war crime — get the extra protections, the extra constitutional niceties that you get in a civilian courtroom, as opposed to someone who attacks a military target? The logic here is perverse.

And the incentive is [perverse]: If you are a terrorist overseas thinking — am I going to attack a well-protected military installation? [No,] I will hit a civilian [target]. I will be in a cozy cell with a lawyer, Miranda rights and perhaps even a blog. Why wouldn’t I attack innocent civilians?”

Sunday, Nov. 15, President Obama and Russian president Dmitry Medvedev said in Singapore that time was running out for diplomacy to resolve the crisis over Iran’s nuclear program. Medvedev added that if discussions failed to yield results, “other means” could be used.

Tehran delivered its comeback the same day: Iranian president Mahmoud Ahmadinejad declared grandiloquently: “Iran is a great world power whose strength is unlimited and on whom no other state would dare impose sanctions,” while parliament speaker Ali Larijani blasted America whom he accused of backing the Saudi bombardments killing Muslims (Shiites in Yemen). Obama is worse than George Bush, said Larijani: “His promise to change US policy toward Tehran amounts to nothing.” He flatly rejected the latest Western proposal to resolve questions about Iran’s nuclear program (overseas processing of enriched uranium) as “unimportant” and “irrational.”

Warner’s analogy is, in itself, spurious. A state cannot “require” an individual to buy and drive a car. An individual may freely decide to not purchase a car and therefore is not *required* to purchase the State’s driver’s license. Under Obama care, we will all be *required* to pay for the State’s license, even if we don’t want the State’s car. Again, Warner’s analogy is itself—spurious
