October 5, 2004 -- One of Mike Tyson's bodyguards was arrested on a rape charge early Sunday after he was found having sex in a hallway of the tony Rihga Royal Hotel in Midtown -- but the Manhattan DA declined to prosecute him, sources told The Post.
Police were called to the hotel after a guest, returning to her room at 3 a.m., reported seeing a couple having sex in the hallway on the 22nd floor.
Cops found the hulking bodyguard, a 49-year-old man from Georgia, in the hallway with his pants around his ankles, passed out on top of the woman.
The woman, a petite 22-year-old, couldn't get out from under him, and cops had to roll him off her, a source said.
