Texas has changed their laws over the past several years. By Texas law I don’t see where he committed a crime.
Texas statutes divide protection into four areas. They include the amount of physical force that can be used to defend:
· the person (self-defense),
· the person’s property,
· others (third parties) and
· the other’s property
The use of deadly force is the element of preventing a crime against the person or property or preventing someone from fleeing after committing specific crimes
The following is a definition of the crimes when deadly force may be used to prevent their imminent commission:
Theft–appropriating unlawfully the property of another with the intent to deprive the owner of the property. The appropriation is unlawful when the owner has not consented or when the property is known to have been stolen.
Says it all right there and it looks as if this gun totin’ neighbor knew his rights.

If a burglar crosses my threshold, he has already demonstrated his malevolent intention and while leaving his rights and his presumption of innocence outside.
