Woman Who New York Times Claimed McCain Had An Affair With Is Suing

It’s about time. I was never a McCain supporter this election season, but he was hardly deserving of that kind of a hatchet job.

Washington lobbyist Vicki L. Iseman has filed a $27 million defamation lawsuit against The New York Times for a February article about Iseman and her relationship with Sen. John McCain.
The suit, filed in U.S. District Court in Richmond on Tuesday, alleges the article falsely communicated that Iseman and McCain had an illicit “romantic” relationship in 1999 when he was chair of the Senate Commerce Committee and she was a lobbyist representing clients before Congress…
The 36-page complaint charges that the story implies an “unprofessional relationship” between Iseman and McCain.
Both Iseman and McCain denied any improper relationship. However, the public viewed the story as being about an affair, according to the suit, which cites the post-publication remarks of 10 different commentators across the political spectrum. In each case, their comments about the story assumed it was about an alleged affair, the lawyers noted.
The Times’ own public editor, Clark Hoyt, published what Allen called a “blistering attack” on the Times’ decision to publish the original Iseman article.

If Iseman wins her suit (it’s a tough case to win, but who knows), it’ll hit the Times right where it hurts: the pocketbook.
With the paper teetering on the edge of insolvency, they can hardly afford to settle a lawsuit like this.

    What lioncourt said. I have a hard time seeing this as a winner for the plaintiff. It was a pretty crappy article, but dunno if it’s really libel. I skimmed it again, and didn’t see anything there that couldn’t be defended as the truth (“advisers say that…..” being typical construction, and I’m sure some advisers did say X.)

    Who cares what they said about McCain? He’s a big boy, and a career pol, he can deal with them. What they did here was wrong, and she has an attorney who has actually gotten quite a few large judgements for this very thing. I wonder why she didn’t ask for more moola? The Ombudsman of the Times didn’t want this to run and slammed it afterwords, so you know it didn’t pass muster.

    The First Amendment does have its limitations and the causes of actions for libel and slander co-existed with the ratification of the Bill of Rights.

    The Gray Lady will be on firmer ground if their allegations were true and McCain’s alleged paramour was a public figure.

    If she is determined to be a public figure, then under New York Times Co. v. Sullivan, the plaintiff would have to prove actual malice.

    That the Times would side with terrorists against fellow Americans is not surprising. This malignant institution is presided over by a squishy, larva-like creature who is quite proud of his treasonous impulses. Publisher Arthur “Pinch” Sulzberger is fond of telling the story of how he let his father Punch, from whom he inherited control of the paper, know whose side he was on in the Vietnam War. Via NRO:

    When I first heard of this lawsuit, the first thing that jumped out at me, was the false stories that were created by a former NYT writer. The NYT is self-destructing anyway even without this lawsuit. People just don’t trust their news reporting anymore.

    Normally you people would scoff at a lawsuit since you HATE seeing someone get something you didn’t.

    I scoff at lawsuits which are clearly attempts by plaintiffs and their lawyers to cash in instead of correct actual wrongs.

    In a situation like this, where a woman’s reputation and career was damaged by untrue accusations from a national newspaper, I think the lawsuit is appropriate.
