Supreme Court Refuses To Hear Lawsuit Blaming Gun Companies For Shooting Deaths

The State of New York’s lawsuit against the gun companies got shot down by the Supreme Court today, and rightfully so.

WASHINGTON — New York City’s nine-year lawsuit accusing gun makers of flooding illicit markets with their firearms came to an end on Monday, when the United States Supreme Court refused to consider a lower court’s dismissal of the case.
Without comment, the justices decided not to review a ruling by a three-judge panel of the United States Court of Appeals for the Second Circuit, which declared on April 30 that federal law protected the manufacturers from such suits.
The appeals court had overturned a decision by Judge Jack B. Weinstein of Federal District Court in Brooklyn, who ruled in 2005 that the suit could proceed despite protests by gun makers like Beretta U.S.A., Browning Arms, Colt Manufacturing, Glock and Smith & Wesson. The gun companies had complained that a federal law passed just two months earlier shielded them from such suits.

The idea that gun manufacturers are somehow to blame for gun deaths is about as dumb as thinking McDonald’s is responsible for a woman spilling coffee on herself. Or that car companies are responsible for drunk drivers. Or that Burger King is to blame for their customers being fat.
I understand the desire to stop violent crime. I am not pro-violent crime by any stretch of the imagination. But if you want to address violent crime you must address what actually causes it, and that is violent and criminally-minded people motivated by a myriad of social reasons, economic reasons and sometimes just out-and-out mental disorders.
In short, people commit crimes. Not guns.
But then, it seems more and more that we have a problem with personal responsibility in this country. Nobody wants to be at fault. Everyone wants to be the victim.

    The McDonald’s had been warned about serving the coffee too hot. In a story in Newsweek years ago the republican judge overseeing the case said that people didn’t realize what the case was about or the facts behind the decision.

    But it’s typical of conservatives to side with the corporation over the individual. It follows their pattern of always siding with the more powerful entity in any and all disputes. Corporation over individual, management over union, school board over teachers, police over the accused. No thought is given to the facts, they instinctively take the side that has the besty chance of winning. It typifies the lazy, intellect-free, conservative mindset.

    Dino, how are you even able to use a computer? Is someone doing all the typing and clicking while you watch and spout off stupidity? If someone is so totally ignorant that they don’t understand that coffee is hot, then they deserve anything that happens to them. That’s not siding with anyone, it’s just common sense.     Perhaps it’s apparent to some, but many are completely oblivious to the fact that for a politician or an officer of the Court to attack the Right to Keep and Bear Arms is for them to breach their oath to uphold and defend the Constitution from all enemies, foreign and domestic.

    The Oath of Office has slight variations, depending upon what you do for government, but all of them entail defending the Constitution.

    The Second Amendment is the Constitution.

    For without the teeth of the Second Amendment, all the other rights can be swept away in the blink of an eye. It is only the threat of an armed citizenry that serves as an ultimate check and balance against tyranny.

    I say the Second Amendment is. in order of importance, the first amendment. It is America’s First Freedom, the one right that protects all of the others. Among freedom of speech, of the press, of religion, of assembly, of redress of grievances, it is the first among equals. It alone offers the absolute capacity to live without fear. The right to keep and bear arms is the one right that allows “rights” to exist at all.

    The issue here Dino is that conservatives accept individual responsibility for their actions. If I hold a cup of coffee and burn myself, I’m not going to sue somebody over it.

    Liberals assume collective responsibility for their actions. She knew the coffee was hot when she picked up the cup. Unless she were a child she should be able to understand the risks inherent in that.

    Morally, you liberals still are children. You’re always looking for Daddy to rescue you from your actions.
