Senator Craig Perhaps Not Resigning After All

I don’t think it’s in anyone’s best interest to exacerbate this.

BOISE, Idaho (AP) A spokesman says Senator Larry Craig is reconsidering his decision to resign after his arrest in a Minnesota airport sex sting and may still fight for his Senate seat.

Craig’s spokesman, Sidney Smith, says resignation is “not such a foregone conclusion anymore.” Craig has said he intends to resign from the Senate on September 30th following his guilty plea to a misdemeanor charge stemming from the sex sting in a Minneapolis airport restroom. But his spokesman says since then, Craig has hired a prominent lawyer to investigate the possibility of reversing his plea.

Smith says a telephone call Craig received last week from Senator Arlen Specter, urging him to consider fighting for his seat, is affecting Craig’s decision to reconsider his resignation.

As Craig considers not resigning, he was a no-show at work today.

Regardless, I’ve said before that I do think Craig should fight his arrest in court.  I think the arrest was wrong, and that the laws used to arrest him are dangerously vague.  Senator Craig didn’t do anything in that bathroom outside of communicate to another adult the fact that he was looking for sex.  While that’s creepy, it’s hardly a crime.

But while I think Craig should fight, I don’t think he should be doing it from a seat in the Senate.  He’s disgraced himself by cheating on his wife and engaging in conduct unbecoming a US Senator.  He should resign and focus on putting his life back together.

That’s a pretty popular hobby in Washington you know.

I agree that the charges were bogus.  Picking someone up for flirting is wrong. 

On the other I wouldn’t vote for the guy again as it’s quite likely that he intended to have anonymous sex in a bathroom in an airport.  Super-Creepy is too weak a word for it.

If I heard he was hanging out with Barney Frank in his spare time it wouldn’t bother me near as much.  Anonymous sex in a public bathroom does.

That’s a pretty low bar to hit! (Craig kill anybody in his Oldsmobile? Run a brothel out of his home? Huge piles of bribe money in his freezer?)  Actually, it looks like he fits right in!

Pouty lipped Sgt. Karsnia and the Minneapolis police are playing an insidious little game racking up arrests for foot tapping and hand waving in the airport bathrooms. When was the last time a hooker got arrested for waving at you as your drove by?

Karsnia motions a foot tapper to a private area and tells him that he knows that he was asking for sex. He then offers to let the problem go away if the hand waver pleads guilty and pays a fine. There is no need to contact the media.

This is clearly extortion and the wide stance guys have clearly committed no crime. Karsnia is the criminal. The gay community should be up in arms and clamoring for the ACLU to step in. Every single guilty plea that pouty lips has coerced out of people this way should be overturned.

If they really wanted the problem to go away, the cops would make the arrests as public as possible. Actually, the Minneapolis police no doubt wanted to keep their crimes quiet, too. For now they have their arrest records intact and their revenue stream flowing. Psychs call this enabling. Citizens call this a speed trap. Judges call this a crime.

The majority of the actual evidence, by the way, points to Craig not being guilty and not being gay.

Regardless, I’ve said before that I do think Craig should fight his arrest in court.

I doubt he can fight this in court.  He knowingly pled guilty.  I don’t doubt that he did it primarily to keep it quiet and not because he felt he was actually guilty.  However, the guilty plea is a final judgment and the fact that his plan to keep it quiet didn’t work is not grounds to overturn.

I’ve been hunting once, does that make me a hunter?

Actually I don’t believe that being gay or straight is a binary system.  Their is some sort of probability curve involved.  In simplistic terms, Craig is probably bisexual.

In fact, there is no “evidence”, since nothing has yet been presented in court.  All the police have is unsupported testimony that has not been subject to cross-examination. They lied to Craig to get him to “plead out”, a common police tactic when they know they can’t prove their case.


If govt control of the economy were the way to go, the Soviet Union would be the richest, most powerful nation in the history of the world.

The gay community should be up in arms and clamoring for the ACLU to step in.

They don’t ‘step in’ unless they are asked. They’re not some sort of government agency thank God.

Finally my theory has caught on: yeah he plead guilty but he had no other choice. The MSM positioned him that way. I still think the whole thing is a figment of the cop’s imagination and I think he’ll be exonerated after a quick trial reveals no criminal intent nor criminal act took place or was even going to.

Craig was sentenced.
Craig pleaded guilty by mail.
There is some doubt as to the legality of the plea without
advisement of his right to counsel.

It’s not enough for the defendant to say he is proceeding without counsel. He must be advised of his right to counsel and waive that right. (State v. Vieburg, 404 N.W.2d 312, 314 (Minn. App. 1987.)

  An accused has the right to withdraw his plea of guilty upon establishing a denial of his right to counsel. McMann v. Richardson, 397 U.S. 759,

Are you stating he didn’t get read his rights?  I would find it hard to believe that a Senator did not understand his rights if they were read to him.

Craig needed to be advised again of his right to an attorney when pleading.

It’d be pretty easy to claim distress.  Do you want to plead guilty or do you want your name splashed all over the media ruining your political career and likely your career after your political career.

The charge is worse than the punishment.

Absolutely.  He knew even the accusation of a sex charge would ruin him in today’s MSM, so he took the bait: the cop offered him the plea to disorderly conduct to “make it all go away”, and Craig fell for it.  The cop fattens his arrest and conviction record, and Craig gets smeared anyway.  Another present for the Dems.  They can take out another Republican, and keep gay people on their plantation, all in one move.

If a Senator does not know the severity of what he is about to admit to, what can we expect from an average Joe?  He was playing footsies with a cop and got busted. 

But then again, Teddy Kennedy went of a bridge and left a young lady under water and he is still in office.  Let me see, footsies with a cop or leaving the scene of an accident that resulted in death.  I’ll leave it up to America to decide which one deserve to be expelled from the Senate.
