Selective Prosecution

John at Powerline has just caught something huge over the Valerie Plame incident.

No, Judith Miller sat in jail until the prosecutor agreed that she would not have to testify about any source of the information about Valerie Plame other than Libby. Miller had multiple sources, and everyone already knew that she talked to Libby. The real question is, who was her other source? Some have speculated that it may have been Plame's husband, Joe Wilson, or maybe another journalist. Now, we may never know.


If she's allowed to report on some sources but not all; it will be a travesty of justice.

I’m not sure why they would want to steer the debate away from Iraq.... that situation is looking better by the day. Coincidentally, the MSM has stopped covering it at all unless a bunch of people die....

Oo, this had fallen off the table for a little while.  You can’t forget Rove!

But it’s going to be quite interesting to see how this all plays out with the court. There are some people in the White House that feel, very strongly, they prefer to have a controversial Supreme Court nominee to get the debate in the country back on moral values, cultural values and off of Katrina, Iraq and Tom DeLay.

I’ve been wondering the same thing myself, Whistler. It doesn’t do anyone much good for her testify that she heard it from Scooter Libby if she won’t name anyone she heard it from and when she heard it. Everyone has been asking from the start why she would go to jail when Libby had given her the OK to talk about anything they may have talked about off the record. That told me that Miller was protecting someone else. Apparently she still is.

Should have mentioned that no matter what deal she made with Fitz in a trial she will have to answer defense questions.

Miller might be protecting herself.
Which is a good reason to go to jail.

What matters is did a person or persons knowing Plame was an undercover operative out her .
A high standard to meet.

This is Grand Jury.  There is a prosecuter, but no defendant, therefore no defense questions.

Of course if there’s an indictment, the question of law will be whether or not the defense, (assume it’s scooter), would try to get to the bottom of the matter or concentrate on things that would prove him innocent.

I also wonder if they could even get that introduced that ‘others’ said the same thing.  Probably, but not certain.

The reponsibility of the Grand Jury and Special Prosecuter (like the Olympics) is to find out who broke the law and issue an indictment.

Since the Special Prosecuter (like the Olympics) has given the reporter a free pass, we may never know who she’s covering for.
