School Officials Strip Search Student Suspected Of Having Ibuprofen

That’s right.  Ibuprofen.  As in over-the-counter headache medicine like Advil and Tylenol, though in this case the ibuprofen just happened to be prescription strength.  Meaning each pill is equivalent to two over-the-counter pills.

Safford Middle School has a “zero tolerance” policy that prohibits possession of all drugs, including not just alcohol and illegal intoxicants but prescription medications and over-the-counter remedies, “except those for which permission to use in school has been granted.” In October 2003, acting on a tip, Vice Principal Kerry Wilson found a few 400-milligram ibuprofen pills (each equivalent to two over-the-counter tablets) and one nonprescription naproxen tablet in the pockets of a student named Marissa, who claimed Savana was her source.

Savana, an honors student with no history of disciplinary trouble or drug problems, said she didn’t know anything about the pills and agreed to a search of her backpack, which turned up nothing incriminating. Wilson nevertheless instructed a female secretary to strip-search Savana under the school nurse’s supervision, without even bothering to contact the girl’s mother.

The secretary had Savana take off all her clothing except her underwear. Then she told her to “pull her bra out and to the side and shake it, exposing her breasts,” and “pull her underwear out at the crotch and shake it, exposing her pelvic area.”

As is noted at the link, “Sometimes it’s hard to tell the difference between drug warriors and child molesters.”

No doubt, at least as far as this incident is concerned.  A “zero tolerance” policy that includes something as harmless as Ibuprofen is absurd on its own, but strip searching a student to look for allegedly hidden ibuprofen is beyond the pale.

But even so, the school district’s attorney tries to justify the search with this:

“When it comes to drugs and weapons,” Matthew Wright said, “school districts just can’t take the chance of not going forward and being sure.”

[...]

“Remember,” he says, “this was prescription strength Ibuprofen.”

Cue the scary music.

Honestly, situations like this are why we need school vouchers.  School secretaries strip searching your kids looking for Tylenol?  Take your voucher to another school.  Principles won’t feel like they have the God-like ability to trample student rights if their livelihoods are susceptible to the market forces of school choice.

Comments

I read the link and apparently the family sued as they should have.  A panel of the appeals court actually sided with the pervs.

I have to think the judges are pretty perverted in order to think that this kind of behavior is ok.

There is no way a 13 year old can give permission for a strip search.

It was the “liberal” 9th circuit that found for the school.
We’ll see how the “conservative “ SCOTUS finds.
In general students have no rights .
On or off campus.

If it were a charter school they might have given her a colonoscopy.

If I were a liberal, I wouldn’t want to own the 9th Circuit as one of my own.

Schizophrenic is a better term for them.

I disagree that it would have been as bad in a charter school.  They answer directly to the taxpayer, public schools don’t.

Rob, you should post Sullum’s opening quote:

There are two kinds of people in the world: the kind who think it’s perfectly reasonable to strip-search a 13-year-old girl suspected of bringing ibuprofen to school, and the kind who think those people should be kept as far away from children as possible.

Count me in the latter group.

A strip search should never be used on a student except in the case of suspected illegal items, such as illicit drugs or weapons.  And even in that case, no school administrator, faculty or staff should be the people conducting the search.  Instead, they should call the police and let it become a criminal matter.

As it was, there was no crime committed, even if the teen possessed prescription strength ibuprofen, assuming the prescription belonged to her.  (Prescription strength versions of OTC drugs is a farce, but I digress.)

I’ve instructed my children not to cooperate with such tactics, and to insist on speaking to their father before they say anything (!) that could incriminate themselves. The schools want to criminalize minor infractions, so the school officials will have to deal with me, first.

It’s the law of unintended consequences, as applied to the overreaching nanny state. I’ve lit school officials up on many occasions. Be ready to fight for your kids. Otherwise, the schools will walk all over them.

Apparently the war against drugs is also a war against common sense.

Here in America our schools have zero tollerence policies for such threats to humanity as:

Aspirin
Sucrets
Tylenol
Swiss Army knives
And pictures of guns

But it’s perfectly OK for students to:

Come to school dressed like crack dealers
Come to school dressed like prostitutes
Use the F-word to their hears content
Not do any homework for months on end

As the maitre de in Ferris Bueler’s Day Off said, “I weep for the future.”

The problem is “zero tolerence” rules. I fail to understand the logic of a city that would hire a Masters level to PHD level person and then allow a politically minded school board undermine thier judgement with “zero tolerence rules” that allow for zero judgement.

While that is a valid point, much of the problem lies with parents and their reaction to their kids’ behavior.  In too mnay cases, an administrator exercising good judgement is accused of racism or some other form of bias by parent because the parents just *know* that their little angel would never do anything like this.  It leads to time wasted by the administrators responding to lawsuits or hearings with the school board over a situation where everything was handled correctly.  Over time, it was these types of things that led to “zero tolerance.”

I know a junior high principal who wass accused of racism for punishing a group of 5 students who were engaged in some form of horseplay in the classroom.  Despite the fact that every single one of the boys ws black and they all received the same punishment, he was accused of being a racist.  Fortunately for him, nothing ever came of it.

In the case of the ibuprofen, the school was wrong in how they handled it.  They went way too far.  They deserve to be sued.

At my son’s high school, the black kids are subject to extreme leniency in disciplinary matters. It’s the liberals’ soft racism at work. The other students are well aware of this, and it makes them cynical. I don’t complain about it, as it helps to prepare my child for the realities of the adult world.

Good judgement is hard to find in the schools. My son has been threatened with criminal charges for minor misbehavior on several occasions, like leaving school grounds during lunch to walk to the local supermarket’s salad bar, two blocks away. (The school’s food is awful.) My wife and I have had to to vigorously complain to area administrators about overreactions in discipline, and it has paid off in more level-headed actions by the high school’s VP.

BTW, now that my son often drives to Taco Bell for lunch, and brings back food orders for his teachers, no one bats an eye. He’s become quite popular with the teaching staff in his senior year. My kid is learning how things really get done.

U238, interesting point, but let’s not pretend that the acquisition of a Ph.D. or masters’ degree confers common sense upon the recipient.  My experience in grad school and in life would tend to indicate the opposite is sadly more likely, especially when that terminal degree is conferred by the College of Education.

Rather, what we have here is a situation where all cost vs. benefit is ignored in the basic rush to “keep order.” The only exceptions in such a political scenario are granted to those who....have political pull.

Too true.  I also wonder how many teachers go directly from the liberal ivory towers of university life to their teaching positions without experiencing the trials and tribulations of real life.

Police state!!??  Not hardly and not yet.  Not to say that there are enforcement problems but we have a very long way to go before we are a police state like Nazi Germany, the USSR and other countries with totalitarian rule.
