Financial Disaster on the Prairie

We actually did this on Monday, but with all of the Alerus news coming out I didn’t get a chance to post this until now.

Dear Mr. Hyman:
This is an open records request for financial information from 2008. It was reported in the media that the “Event Fund” had significant losses. The fund began with a positive balance of $250,000 and ended the year with large negative.
The actual amount of the losses seems to be in dispute. The Grand Forks Herald reported a loss of $719,000. The Alerus Commission ran an ad in the Herald that claimed a loss of $630,892. An October 31st story in the Herald said that the loss was $499,000.
When the Alerus Center’s financial results were released late February of this year said that the Neil Diamond concert lost about $250,000 out of the event fund.
We should know how much of our money was actually lost out of that fund and we should know exactly where our money went.
To this end we are asking for an accounting of the losses in the event fund for 2008. We want to know what specific events (name of the events and dates) lost the money in that fund and what amount of money that they lost. We’d like the cost accounting for each of those events that you prepare after those events are completed.
We’d also like an accounting of any and all benefits that members of the Alerus commission may have received in 2008. That includes free admission and or tickets to members of the commission and their families. That also would include any food, beverages and merchandise that they may have received. Basically we want an accounting of anything of value that they may have received.
If you have a policy on that we’d like that as well.
As you are aware North Dakota is an open records state. You can review the law yourself. It’s in section 44-04. If we don’t receive this information in two weeks we will be exercising our rights under the law.

I think it’s really important for us to find out just how they lost the money in the concert fund last year. The fact that they’re reporting three different numbers really makes me think that there’s something just wrong there. The Grand Forks Herald is fully aware of the discrepancy but they don’t care. I guess that leaves it up to us to be the blog of record when it comes to events at the Alerus.
How much do you want to bet that the Alerus hands it off to the Herald so they can report it before they give it to us?

    They are gonna hassle you before they give up the info. They will probably site the portion of the century code that says, “nothing in this section requires a public entity to create or compile a record that does not exist.” and they will probably claim that some info should be excluded for contractual reasons.

    That is all bs, of course. They need to give you the info very quickly, like a day or two at the most. You should have the documents by now if you requested them on Monday. If not, ask the AG (with a Short Letter) to rule that they are in violation of open Records laws.

    No disagreement. But these guys are rogues. They operate without any concern of the law. They have already called critics “morons.” and were not fired, which should have occurred. They know that there are no limits to what they do. Newman and Kreun own the commission, they have a city council backing them, and they have a good ole boy as AG. Not to mention the local paper.     Obama is smart enough to know he doesn’t have to give them recognition by appearing on their network. FOX only attacks him……the others are fair and balanced with Obama. They criticize him fairly and they also give him praise.

    Fox doesn’t need or anyone from his administration to be on the network to stay in business or to get their partisan views out.

    Obama is showing some balls here….

    A final note,

    The Attorney General is required by Century Code to make his decision based on information provided by the government entity, not proof provided by you. The proof you have will be considered by a judge if you take the entity to court. Word your complaint carefully. Any extra information will be used by the City to distract from your real points.

    Bobbie, one thing you should know by now is that politics makes for strange bedfellows. I may disagree with just about all of your ideologies, but there will be some things we agree on. It looks like Alerus is one. Take my advice, or don’t. I wish you good luck on this one and hope you can help facilitate some changes here.

    Go in with your eyes open and expect shenanigans.

    A nice preemptive strike. But Hyman has no intention of providing the information. He will put you off until Judgement Day. The only way anyone knows how much has been lost over the years is to sweep out the commission, beginning with Newman and Kreun, and putting people in who give a damn about the taxpayers of GF. But, I’m not holding my breath.
