Ronnie Earle Missing Evidence

Ronnie Earle has stood in front of three grand juries attempting to indict Tom DeLay of crimes.

The first grand jury didn't find cause for an indictment.

The second one indicted DeLay for doing something in 2002 that was against a law passed in 2003, something that violates the Constitution's ex post facto laws.

The third grand jury has now been presented evidence by Earle that may not have ever actually existed. Earle says it existed, but now he can't find it.

Newsmax - The most compelling piece of evidence cited by Travis County District Attorney Ronnie Earle to implicate House Majority Leader Tom DeLay in a money laundering and conspiracy case can't be located, Earle's prosecution team admitted on Friday.

Indictments against DeLay and fundraisers Jim Ellis and John Colyandro allege that Ellis gave "a document that contained the names of several candidates for the Texas House" to a Republican National Committee official in 2002, reports the Houston Chronicle.

The document was touted as proof that DeLay was part of a scheme to swap $190,000 in restricted corporate money for the same amount of money from individuals that could be legally used by Texas candidates.

But Earle's prosecution team told the court on Friday that they had only a "similar" list and not the one allegedly given to the RNC. Late in the day, they released a list of 17 Republican candidates in Texas, but fewer than half are alleged to have received money as part of the alleged DeLay plot.

A similar list?

Sorry, but that doesn't quite cut the mustard. As Bullwinkle points out over at Random Numbers, this may well mean that Earle managed to perjure himself while presenting his case to grand jury number three.

Seriously, if this case turns into any more of a circus Barnum & Bailey's should sign Earle to a contract and take him on the road. They could put him on between the lion tamers and the clowns.

So you’re accepting whatever NewsMax says as the gospel truth? Your faith in the GOP smear machine remains unshaken.

Here’s a few reasons that the story doesn’t pass my personal “smell test”:

1) The primary source is DeLay’s defense attourney.
2) The story details Earle’s past indictments of a Republican--without mentioning that he’s indicted far more Democrats than Republicans.
3) When was the Chronicle article published? Why not link to it. Because NewMax is famous for misreprenting stories, I suspect.
4) The story claims that “fewer than half are alleged to have received money as part of the alleged DeLay plot"---which implies that they are completely innocent. What WERE they charged with? NewsMax is silent on this point.

Dude, why are you defending a political scumbag who misused money for his own leisure?  Do you actually support corruption or are you so dyed-in-the-wool that you’ll subject yourself to such shame?  That’s all it is: a shame!

And newsmax… now THERE’s a “balanced” newssource.  Far right garbage.

So...did you have an actual point to make about Ronnie Earle and his circus of indictments or is this just attack the messenger time?

Honestly, I think DeLay is a bit of a slimeball myself, but that doesn’t make Earle’s indictments of him any less laughable nor does it mean that DeLay has neccessarily broken any laws.

The story details Earle’s past indictments of a Republican–without mentioning that he’s indicted far more Democrats than Republicans.

I’m not surprised that a prosecuter would indict more Democrats than Republicans.

Did you read the lead paragraph? “The most compelling piece of evidence cited by Travis County District Attorney Ronnie Earle to implicate House Majority Leader Tom DeLay in a money laundering and conspiracy case can’t be located, Earle’s prosecution team admitted on Friday.”

2) The story details Earle’s past indictments of a Republican–without mentioning that he’s indicted far more Democrats than Republicans.

The point of mentioning Hutchinson had nothing to do with her being a Republican (the article doesn’t even mention her party affiliation!!), it was to point out that Earle has made erroneous charges in the past, which he has!

3) When was the Chronicle article published? Why not link to it. Because NewMax is famous for misreprenting stories, I suspect.

OOOooorrr… they are not a blog, but a news magazine and don’t “link” to stories, they reference them. And if you simply did a quick Google Search, you could have easily found the article they referenced…

4) The story claims that “fewer than half are alleged to have received money as part of the alleged DeLay plot”—which implies that they are completely innocent. What WERE they charged with? NewsMax is silent on this point.

Doesn’t matter, does it?  Only half of them had anything to do with DeLay…

No qoutes, no documentation, no direct atribution of the prosecution. A GOP propaganda firm disguised as a news source---with a well-documented history of twisting the facts and outright lying---merely CLAIMS to paraphrase the procecution. Not good enough for me, or anyone else with half a brain.

The point of mentioning Hutchinson had nothing to do with her being a Republican (the article doesn’t even mention her party affiliation!!), it was to point out that Earle has made erroneous charges in the past, which he has!

Bullshit. NewsMax knows its audience, and they clearly intend to imply that Earle procecutes Republicans on trumped up charges.

Thanks for linking to the article that NewsMax COMPLETELY MISREPRESENTED (in typical GOP fashion, I might add). NewsMax reports that the procecution case is “destroyed,” while the Chronicle details the OTHER evidence against DeLay.

Seriously, people---as long as you continue to use White House shills as your primary news sources, you’ll continue to be duped. They are playin’ y’all for chumps---and quite frankly, it’s working.

Garbage in, garbage out.

At least in the Hutchinson case he did.

They were reporting a fact, why do you need a quote?  If I say, “Its sunny in Florida today”, do I need to back it up with a quote from someone in Florida? No… The fact they were reporting was that Ronnie Earle’s team did not have the list that was apparently key to their charges…

Bullshit. NewsMax knows its audience, and they clearly intend to imply that Earle procecutes Republicans on trumped up charges.

Um, don’t buy it.  To be honest, I had to look up Hutchinson’s bio to find out she was a Republican, I didn’t know.  If they had wanted to imply that Earle only goes after Republicans, they would have specified that she WAS a Republican.

Uh huh… Let’s take a look at the lead paragraph in both stories.

Travis County prosecutors admitted Friday they lack physical proof of a list of Republican candidates that is at the heart of money-laundering indictments against U.S. Rep. Tom DeLay and two of his associates.

The most compelling piece of evidence cited by Travis County District Attorney Ronnie Earle to implicate House Majority Leader Tom DeLay in a money laundering and conspiracy case can’t be located, Earle’s prosecution team admitted on Friday.

Both stories are not about the case against DeLay but about the missing evidence.  What does the other evidence have to do with this story? It doesn’t.  This story is about a prosecuter screwing up one of the more important peices of evidence (without which he may not have gotten the third grand jury to finally indicte...?)

[...] I’m no legal expert, but from what I’ve heard of the situation it took Earle three separate grand juries to finally get DeLay booked on a crime. The first grand jury refused to indict. The second indicted him for violating a 2003 law in 2002. The third grand jury was presented evidence that the prosecutor has now “lost.” Is this a weak indictment? It sure looks that way to me. Is it politically motivated? Given what we know about Earle, it sure sounds like it. Unless there is evidence presented during the trial that isn’t public now I can’t see DeLay getting convicted of anything. I think this all had more to do with Earle getting DeLay in front of a mugshot camera. Its all about muddying the waters. [...]
