Obama To Re-Appoint Pro-Fairness Doctrine Commissioner To The FCC

Reagan gave this guy the axe back in the 1980′s, leading to the FCC deregulation that allowed for the rise of conservative talk radio. Now Obama is looking to put him back at the FCC.
Can the Fairness Doctrine be far behind?

Henry Rivera, a longtime radical leftist, lawyer and former FCC commissioner, is expected to lead the push to dismantle commercial talk radio that is favored by a number of Democratic Party senators. Rivera will play a pivotal role in preventing critics from having a public voice during Obama’s tenure in office.
Rivera, who resigned from the FCC nearly a quarter-century ago during the Reagan years, believes in a doctrine of “communications policy as a civil rights issue”.
His exit during the Reagan Administration paved the way for the Fairness Doctrine’s repeal when the late president appointed Patricia Diaz Dennis in 1986 to fill out the rest of Rivera’s term. Had this not occurred, talk radio as we know it today would not exist.
That gives Rivera’s new task a great deal of personal urgency: it’s a late-career, second chance opportunity to shut down opposition voices that have been allowed to flourish since his depature from the commission.
In particular, Rivera is known for his push for more minority broadcasting ownership, but this issue has largely been rendered obsolete as former commercial broadcasting empires teeter on the brink of bankruptcy.
Rivera’s first opportunity to eliminate commercial talk radio will occur in June 2009, as the term of Republican Robert McDowell expires and he can be replaced with a pro-Fairness Doctrine Democrat. That will give the commission a three-vote Democratic majority, though the final two seats must remain in Republican hands.
If they can strong-arm one of the three Republicans into leaving early, this can be implemented even sooner.

Remember that it was an Obama campaign lawyer that was threatening television stations which ran an NRA ad with FCC regulator action. It was the Obama campaign that tried to shut down Milt Rosenberg’s radio show when he had National Review’s Stanley Kurtz on to talk about Obama’s connections to Ayers. And now it’s President-elect Obama that’s planning on turning back the clock at the FCC a couple of decades.
This is a dangerous, dangerous time for free speech folks.
On a related note, only liberals would think that “fairness” is something that can be implemented by government mandate. but that speaks to how they see the world. This country was founded up on the idea that all men are free, and that all should have equal opportunity to pursue life, liberty and happiness. But rather than equality of opportunity, liberals are only interested in equality of outcome.
Thus the Fairness Doctrine, which mandates “fairness” by forcing broadcasters to not select content based on what people actually want to see or hear (entertainment/informational value) but rather on ideological quotas.
Thus affirmative action, which mandates “fairness” by forcing employers and universities to select applicants and employees based not on merit, ability and achievement but rather on racial/gender quotas.
Thus welfare and wealth redistribution, which mandates “fairness” not by providing incentive for unsuccessful individuals to become successful but by punishing successful citizens for being too successful through the redistribution of their wealth to others.
It’s how the liberal mind works.

So you don’t think the citizens in a market are entitled to hear all sides of an issue? I think it is unfair to citizens in any community when their radio stations only carry voices from one side be it right or left. The airways belong to the public not to one political party. How is it in the interest of our country for its citizens not to be fully educated. For there to be only one voice on the air leaves an ignorant populace and thats not good for anyone – unless you don’t want people to hear the other side of an issue – if that’s the case you have no interest in the people but in pushing an agenda.

  • lori

I heard that re-instating the pro-fairness doctrine would restore news programs to just that. Instead of reporters giving unsolicited opinions, they would be required to get both sides of a story…without personal rants. Personal comments would be left for entertainment type shows: Rush Limbaugh, the Daily Show. If done right, it shouldn’t be mostly liberal or mostly conservative. Sounds good to me! Its soooo tiring listening to a bunch of reporters giving their “opinions” and calling it news…like living in the days of yellow journalism. Entertainment shows would be just that—they wouldn’t be cut, just not “news”

Just a few questions I have. Will the Fairness Doctrine apply to Spanish speaking stations – have to broadcast in English and Spanish, Christian radio stations – have to play non-Christian/religious music and no religious comments from the DJ’s, will it apply to TV news, newspapers, magazines, perhaps even the internet? Will book stores have to have equal displays of liberal and conservative books? Will it apply to members of Congress who give press conferences? And most importantly, will the media ask the Obama administration and members of Congress any of these questions?

Hussein and his Muslim/Marxist miscreant pals are about to confirm the utterly fraudulent title of the “Fairness Doctrine.”

The Marxist/Liberal mindset KNOWS the potency of deception. Deception always infects the following catagories of fools: 1)Those who can be fooled ALL of the time and, 2) Those who can be fooled SOME of the time. Those were part of the real swing votes in this fraud’s election.

Of course there are those who actually hate America so much that they want the brand of change that Hussein Obama is not being totally honest about. Those are the ones who would make great soldiers in the “Civilian” National Security Force. Hussein’s Marxist jackboot pals could well be sewage required to force “change” from a free Constitutional Republic to the iron influence of Karl’s iron redistribution policies.

Those who have spanked and tossed out the innocent have created a sword for all-including fools.

The feds should not attempt to censure any speech. While I find the anti-intellectual talk radio crowd to be repulsive in theory, I find much of it entertaining, and they have every right to say what they think and make money based on selling advertizing. The message they espouse is a legit expression of speech. It is often the lowest possible intellectual discourse, but that makes no difference. It isnt the feds job to decide what we should or shouldnt be listening to or watching. This is an issue that states and locals have the right to address, but the feds should stay out of it. Let the people decide what they want to absorb, even if it isnt always good for them. We dont need a nanny state of thought or action.

Mantrain, obviously paid by the new Machine to comment… “It’s cool guys, the government knows what’s best for us.. I mean, sure, Conservatives are okay, but seriously- you don’t really think Rush Limbaugh should be allowed to speak freely, do you? Sean Hannity, he is way too scary- we don’t want to have ideas and thoughts slanted too far one way. Never mind the fact that 98% of mainstream media is liberal- all we care about are the scary Conservative segments. I mean, I’ll eat dinner with them and stuff, I just don’t want them speaking freely. We’ll just call it something like..hmm.. The Fairness Doctrine!!”

Wake up good People of America. Those of us who listen to talk radio are some of the most informed in the country and need to stay that way.We may not always agree with the host no matter what radio host you are listening to,but the information you are getting is the most accurate available.
A lot of the people who listen in are truck drivers out on the highways of this great land,as am I,and we need to know what is going on in this country since everything we do is regulated out the a**.Keeping us informed is a great way to get the word out to others who are not listening and just waiting for the “news media” to give the wrong info.
People we need to be more outward and demand that the government keep us informed on what is going on because this is OUR country and they are elected officials not God’s as some of them seem to think.

Man Train is an idiot. It’s called a free market and it’s that simple. The liberals are whining and complaining because they can’t compete in the radio environment, they’ve tried, but they usually lack the substance and consistency found in conservative radio. They can’t get a customer base, so they plead for government intervention. How sick.

Again, success is punished in our society. The Liberals already have a huge “blogosphere” and all but one of the major television networks, perhaps this is why conservative radio is concentrated in radio. Limbaugh and Reagan don’t spew hateful ideas; that’s Liberal code word for not agreeing with them.

The Fairness Doctrine is highly unlikely pass, probably impossible. There are few people, except those on the far ends of the spectrum (both ends) that think censorship is a good idea. The Problem here is.. and it is simple.. the far ends both have big mouths with no fear of using them. When one speaks, the big mouth on the other end speaks back with an opposing view (it doesn’t matter if they are on the same side or not, they oppose each other out of something they call principle.) The people who suffer are those in the middle getting crap from both sides.

  • Carol

How far can they go with the Unfairness Doctrine? Radio only? Or will they also censor TV, newspapers, magazines? Does the FCC regulate the internet? How about XM radio?

If Obama and his thugs were to reinstate the fairness BS the one power we have remaining will be to quit buying anything their advertisers sell. Advertising is what keeps any kind of programming on the air. AM radio will cease to exist. It will just be rap crap on all the FM stations. If that were to happen I would become a hermit.

If and when the Fairness Doctrine is pushed by Obama, the right side should all go to Washington and do a Million-Man Anti-Socialism March. We would be surrounded by Obama’s goon squad and whoever fires the first shot will start the new Revolution.

  • The Owl who says South

something fun to think about, is that Obama will have the Patriot Act backing him. That act gives the president many, wide powers. Bush hasn’t abused them, at least not in any noticeable way. phone taps, surveilence.

did you know that act gives law enforcement the right to enter your home, and confiscate all your firearms, if they SUSPECT you are a terrorist? if you threaten someone, you are charged with TERRORISM? serriously, it happened to my sister. she’s… a bit unbalanced. Bi-polar. anyhow, she kinda sorta threatened someone, and BAM they charge her with Terrorism.

these are laws. they were put in, to make us feel safe. Security comes at a cost. thankfully, Bush hasn’t abused these Security mesures… but when i think of Obama having them…

Beth: No govt agency is decreeing that leftie talk radio is a failure; it failed because it didn’t attract listeners who were willing to give business to the advertisers. It’s the wisdom of the free market. The people of this country have chosen conservative talk radio; it was never forced on them. You want to force radio stations to carry programming that doesn’t pay its way and which people don’t want to listen to.
Totalitarianism is what you suggest. People voted with their dollars for conservative talk radio; it’s a superior product.

The Fairness Doctrine is a Social program not allowing one side or point of view without equal time to the other side.

If this happens it will not just affect Radio. It will affect Television. Commercial Television. This is the first step to silencing critics of anyone who disagrees with the Obama Presidency or his programs. (Which will never Happen) in this economic downturn.

Now if it does happen We the people of the United States can stop it by contacting our Senators, our Congressmen and tell them it is silencing our First Amendment right of Freedom of Speech. If they vote it in they shall not be re-elected.

We have the power. Obama does have very little power when it comes to this. Give him 100 days and see what happens. It is going to be fun to watch.

Oh, the change is coming alright. The change is to Socialism.

Just go ahead and try to shut down Conservative talk Radio and there will be millions in the Streets. People like Rush, Michael Savage, laura Ingraham and others have huge audiences and they are the kind of audiance that could get pretty roudy if the Democrats threaten free speech.
With the Democrats controlling the Presidency, the house, and the senate, shutting down conservative talk radio would be like crushing the last voices of dissent.

The Fairness Doctrine needs to be leveled on the TV News, not talk radio.Rush Limbaugh is 98% truthfull, The main stream media did a ugly smear campaine on Sara Palin her because HATE is all they know how to do. Talk radio should be regulated as pornography is regulated. It is truly sad to know that hate mongers such as Rush Limbaugh and Michael Reagan are not only voices on the radio but are also nationally syndicated. As much as I believe in freedom of speech I do not believe there should be easy access to pornographic and hateful/sadistic material. Such materials are sectioned off into “adult only” sections or distributed through specialty shops and underground interest groups (i.e. child pron & Neo-Nazi propaganda). These people and their hateful ideas do not espouse behavior that encourages a peaceful, egalitarian, and civilized society.

That is one of the stupiest things I have ever read on this blog, bravo. You’re talking about a world that doesn’t exist, there is no fairness in the media the fact that the dems are trying to enact this law should scare people they are trying entrench themselves and stiffle speech that doesn’t agree with them. If anything talk radio keeps the left in check and from over stepping their power and controls them.

The argumet could be made about the MSM and print media.

  • Man Train

Maybe the Fairness doctrine won’t be too bad. I am kinda looking forward to seeing Michael Savage or Rush sitting beside Robin Mead at CNN giving their side of the news. Also maybe it would force the liberal media to five equal time to all canidates, because any support given to one must also be given to the other.

Perhaps these liberals should be careful what they ask for.

  • Tom Johnson

The Fairness Doctrine, in effect from 1927 until Reagan repealed it in 1987, applied to the public airways only (basically, radio.

It did/does not apply to cable tv). It required broadcasters to devote some of their airtime to discussing controversial matters of public interest, and to air contrasting views regarding those matters.

Contrasting views could be done through news segments, public affairs shows or editorials. Even by not hanging up on people who are not “dittoheads.”

In 1969 United States Supreme Court called it the single most important requirement of operation in the public interest for grant of a renewal of license. The airwaves belong to the American people, and station owners may NOT run a station as a propaganda arm of the any political party.

So, what does the Fairness Doctrine NOT require:

It does not require that each program be internally balanced.

It does not mandate equal time for opposing points of view.

It does not require that the balance of a stations program lineup be anything like 50/50.

With regard to conservative talk shows, they have always flourished, even when this was in force. Also, not one Fairness Doctrine decision issued by the FCC has ever concerned itself with talk shows

While it may be true that it was “a pain to enforce” its main value was in its codification of the principle that broadcasters had a responsibility to present a range of views on controversial issues.

In 1987, the Fairness Doctrine was repealed under Ronald Reagan and conservative radio swept that land as radio stations saw no need to offer a counter point to these opinions. In 2002, Edward Monks, a lawyer in Eugene, Oregon, studied the two commercial talk stations in his town. He found 80 hours per week, more than 4,000 hours per year, programmed for Republican and conservative talk shows, without a single second programmed for a Democratic or liberal perspective. This was in EUGENE OREGON!

Monks rightly concluded that “Political opinions expressed on talk radio are approaching the level of uniformity that would normally be achieved only in a totalitarian society. There is nothing fair, balanced or democratic about it.

The Fairness Doctrine is anti 1st amendment. If they even try to dicuss it it should be applied to all airways including television and radio. It should also include the print media.

There is no question that the main street media has no comprehension of fairness, just look how they acted in this election.

This is the 1st step to taking away the rights of the American people. What is next, abolishment of the 2nd amendment.

What about network TV? The network news shows are 97% leftist. Won’t a fairness doctrine allow conservatives to get 50% on the networks? I know the leftists won’t allow it, but I’m wondering what their strategy will be to prevent it. Will they just limit the fairness doctrine to radio?

  • deadrody

Does it really even need to be said that the someone’s opinion of how the media should be regulated in 1986 is so completely irrelevant in the year 2008 ? Unbelievable. For me, this has to be one of the single biggest issues that needs to be fought with the Obama administration. And that goes all the way to the stations impacted IF they enact a Fairness Doctrine. They need to tell the FCC to stuff it and take that BS all the way to the Supreme Court.

Multichannel News, citing informed sources, reported former Democratic FCC commissioner Henry Rivera will focus on the telecom agency and its issues as part of the Obama transition. Rivera, who works at the same law firm that once employed FCC Chairman Kevin Martin, and the Obama transition team did not return calls for comment.

According to a source familiar with the situation, Rivera likely would not play a major role in decisions about staffing the FCC with a new chairman and bureau chiefs. Those decisions are apt to be made at a later date by Obama advisors focusing on personnel. With the economy in tatters and the biggest issue for voters in the presidential election, Obama’s first cabinet appointment could be treasury secretary.

So you don’t think the citizens in a market are entitled to hear all sides of an issue?

I don’t think that citizens are entitled to any particular flavor of radio or television content whatsoever.

Radio stations and television stations air the content the masses want. If they didn’t, they’d go out of business. Forcing privately-owned broadcast stations to air content there’s no market for is unfair.

And citizens do get all sides of the issues. Now more than ever. Internet. Newspapers. Magazines. Network news.

A lack of information isn’t a problem. Government mandating content would be.
