Killing a fetus without the consent of the mother, except in the case of a medical procedure required to save the life of the mother when consent can not be gotten, is treated as homicide types in the New York Penal code.

125.00 Homicide defined.
Homicide means conduct which causes the death of a person or an unborn
child with which a female has been pregnant for more than twenty-four
weeks under circumstances constituting murder, manslaughter in the first
degree, manslaughter in the second degree, criminally negligent
homicide, abortion in the first degree or self-abortion in the first
degree.

Interesting how the penal code says nothing about a fetus while implicitly identifying it as the unborn child that it is.  More evidence that what abortionist are doing is killing humans.
