If you were thinking about riding your bicycle to the bar, hoping it would be a legal alternative to drinking while driving, think again. A man who was arrested and convicted for DUI while riding his bicycle just had his conviction upheld by the North Dakota Supreme Court.

You can read the ruling here.

The case came down to what the legislature intended to define as a “vehicle” for the purposes of the state’s drunk driving laws. It appears, from my reading of the ruling, that the court got the right of it.

I’m not entirely sure I agree that riding a bicycle after drinking should be illegal, though. What’s next, making it illegal to walk home from the bar?

Why don’t we just try to ban alcohol again?
