Murtha Wants Immunity In Slander Lawsuit

He’s claiming that when he erroneously called several of our troops cold-blooded murders he was acting in his official capacity as a member of the House of Representatives.

Which might be a sound and adequate technical legal argument, but doesn’t that sort of make the whole thing worse?  It was one thing when they were just come comments he made.  But official statements calling our troops murders from a member of Congress?

Ugh.

A Marine who sued U.S. Rep. John Murtha for defamation urged a federal appeals court Tuesday to order the Johnstown Democrat to testify under oath in the case.

An attorney for Staff Sgt. Frank Wuterich told the court that he needs Murtha’s deposition to determine how often the congressman made the claim that Marines in Iraq engaged in “cold-blooded murder and war crimes” in the slayings of civilians in Haditha.

A government attorney representing Murtha told the judges that the lawmaker has immunity from the lawsuit because he was acting in his official role as a lawmaker when he made the comments to reporters.

Arguments about whether Murtha must testify was argued before a three-judge panel of the U.S. Court of Appeals for the District of Columbia.

I actually think Murtha winning re-election might have been a more depressing outcome from the 2008 elections than Obama getting the White House.

Of course, that hinges upon whether or not Al Franken wins the recount in Minnesota.

. Uh.. What’s wrong with this picture? Our goverment officials should be “More” accountable. Not “Less”. They vote this into law with thier last Pay-Raise?

What a heartwarming response from Murtha and his mouthpiece.  Let’s hide behind the old “official capacity” dodge.  What ever happened to the “real Man”  who takes responsibility for what he says and does?  Oh yes, that went out with another great one—-Bill Clinton.

I think Murtha should be caned for the crap he has said. Just think, the few things we know he said, what has said that we never hear about? Bet it is a helluva lot worse. He is a racist, traitorist pig of the first order. I hope no black people or military families voted for him.

Murtha as an official of this government judged these Marines guilty without benefit of a trial, that is UnAmerican, although it happens all the time, even among some conservatives. He, as Nixon before him was accused in the Helter Skelter case, were both recklessly irresponsible in their words, but: (1) Apparently there are enough fools in his district to reelect him, to their shame. (2) Justice did not get peverted in this case, these guys were not guilty of any wrongdoing.

Murhta sold his soul for a mess of pottage, in this case the soup was mixed in a liberal caldron, a witches brew that was supposed to elevate him in the Demorat Party; But, even in this he failed, he is a joke, a man that fought for his country with honor and yet will go into his grave with dishonor, not worthy of the accolades they will offer on that day, as he will die in disgrace.

Oh, one last thought, I suspect there would be no law suit at ll, if he had the decency and courage to apologize and admit his poor judgment. Yeah, like any politician will ever do that!

He was not acting in his “official capacity” as a member of Congress, if he was it would be in the Congressional Record.

He said this to the press, outside the bounds of his “official capacity” as a member of Congress. Period. Full stop.
