Michael Phelps Could Face Criminal Charges Over Pictures Of Him Smoking Marijuana

Of course, the question is, can the prosecutor prove his case from a picture?

RALEIGH, North Carolina (Reuters) – Record-breaking Olympic swimmer Michael Phelps could face criminal charges following the publication of a photograph purportedly showing him smoking marijuana, The State newspaper of Columbia, South Carolina reported Tuesday.
A South Carolina law enforcement official said he would charge Phelps if he could prove the U.S. Olympian smoked marijuana in his county.
“This case is no different than any other case,” Richland County Sheriff Leon Lott told The State.

It’s sad that this is even happening. Phelps isn’t exactly making the best decisions in the world right now, but ruining this guy’s career? Possibly sending him to jail? Over marijuana?
He should be treated like any other citizen, for sure, but at what point are we going to realize that our public safety dollars might be better spent on something other than busting and prosecuting pot heads?

    What I can’t stand is all the faux-outrage over this. You’ve got all these news reporters, talking heads, and pseudo-celebs that are acting absolutely shocked that a college student smoked a little pot at a party. As if none of them ever indulged when they were younger (especially ironic considering many of them probobly have gone, or still do go, to coke parties). Phelps should have known the media would seize on any chance to tear him down, as this soceity does to any of it’s exceptional citizens/heroes.

    If I were Phelps I would have said this, “I was smoking tobacco, not marijuana, out of that handheld water pipe.” Sure it’d would be bullshit and everyone would know it, but try and prove otherwise.

    the sad thing about the Phelps “pot scandal” is, that British tabloid could care less about whether or not it’s wrong that Phelps smoked pot (a year ago)… they’re just shooting for ratings, and unfortunately it worked

    If he gets away with this without so much as a fine or any legal retribution, what is to dissuade kids from experimenting with Pot?

    I believe that Phelps admitted to smoking pot so I unless I am wrong I believe the bong was probably lit. This is such a dumb thing to do. If you want to smoke pot why not wait 5 years when you have $20 million plus in the bank and can buy all you want?

    Rob, you’re missing the point of all this, by focusing on your pet issue. The outrage over what Phelps did came from social disapproval, nothing else. Whether or not he gets prosecuted is beside the point. Like the Dixie Chicks, he screwed up, and the Americans who want to protect their kids from drugs have already spoken.
    Phelps, in a business sense, squandered his capital; with all he had, he made a foolish mistake, and even if pot were “legal”, the societal disapproval would have been the same.
    He has turned off a once admiring public, and no amount of pro-drug rhetoric will change that.
    He ruined his image with his own behavior, and there are consequences for that.

    It’s a news item because he’s a celebrity. Everything celebrities do hits the news. How many people really gave a damn about Gibson’s slurs, or Prince Harry wearing a nazi halloween costume. Not all that many.

    The assumption that Phelps is getting so much heat simply because he is a “celebrity” is just plain boneheaded. Phelps is propped up as an American Olympic Hero, not a “celebrity”. Paris Hilton is a celebrity, Phelps is an American hero and role model to many kids.

    That is how America and his sponsors see him and use him to increase sales in their sales.

    When you foolishly assume he has not been lifted up as an example to many children seeking to do follow his footsteps, it becomes comical to suggest you take another bong hit, because how else can you come to such a brian dead conclusion.

    P.S.

    It doesn’t matter what most Americans think between right and wrong. Wrong is wrong and Phelps was wrong to behave in a manner that is not consistent with his willingness to be lifted up as an Olympic Hero.

    The county where he was photographed has a max. punishment of $1000 fine and or 30 days in jail I believe. There is a chance he could go to jail, albeit a very slim one.

    If he’s proven to have smoked pot, and it’s against the law, prosecute him accordingly.

    Using a conviction to make an “example” out of somebody is just plain wrong. What effect this will have on “the kids”, or “America” is irrelevant. If they have something beyond a photograph of him with his lips to a bong, he should be tried as if nobody knew who he is.

    If they can prove it was pot, by all means prosecute. If not, if the photo is all they have, and he is willing to state under oath that it wasn’t, it’s not worth going after.
