Mark Foley Needs Some Jail Time

Honestly, what a perv.

Though, on a brighter note, there does seem to be some hope for keeping Foley’s seat in Republican hands.

Yeah, a leadership deputy whip to DeLay, to boot.
Mark “family values” Foley may go to jail under the very laws he auhtored.  I hear his name will stay on the ballot.  It will be interesting to see how many people in his District will vote for a pedophile.

One Eyed Jack on September 29, 2006 at 06:47 pm

The understanding is that all the votes cast for Foley will go to the Republican replacement.  That would be “accused pedophile”. There is no evidence yet that he actually committed any pedophilic acts.

robert108 on September 29, 2006 at 07:38 pm

Interesting.

My reaction is that if the cost of sending this paedophile packing (preferably to prison) is the loss his seat in , or even of the Republican Majority in the House, it’s a price worth paying.

Yes I agree with you, Foley needs to be treated in a clinic and separated from the society for a long time.

Thank you for sharing this story with me !

Ney and the Democratic Congressman from Lousiana are guilty too. Both need to at minimum spend some time under in prison, possibly trialed for treason and executed.

Now, from Woof(of all people), we hear that the age of consent in DC is 16, which would make the pedophile accusation false.  If it had been up to you, this guy would have been punished for something he didn’t do.  Is that what you want? rbb: It’s not my cup of tea, but if the age of consent in DC is 16, then you lie.  It was elected official(s) and young man, and that’s an entirely different matter.  The hypocritical Dems want “gay everything”, unless it’s done by a Republican, then they pounce.  I thought “the President of the United States and a very young intern” was a problem, but the Dems certainly didn’t think so; now they do.  Isn’t that the definition of hypocrisy on their part?  Are you homophobic, rbb?

Age of consent isn’t everything under the law.  For example:

§ 22-3010. Enticing a child.

Whoever, being at least 4 years older than a child, takes that child to any place, or entices, allures, or persuades a child to go to any place for the purpose of committing any offense set forth in §§ 22-3002 to 22-3006 and §§ 22-3008 and 22-3009 shall be imprisoned for not more than 5 years and, in addition, may be fined in an amount not to exceed $50,000.

CV Rick on September 30, 2006 at 08:58 am

Clinton=over 50; Lewinski=20. Where were you then, Rick?  Not only that, but he did a lot more than “entice”, didn’t he?

If someone is beyond the age of consent, they are no longer a “child”.  This law was specifically made about older children victimizing younger children.  Nice try.

rob, it not age of consent in D.C. he has to legally worry about:

Its the FBI and the Feds that will probably get him:

Age of consent in NOrth America

Federal Laws
{Chapter 117, 18 U.S.C. 2422(b)} forbids the use of the United States Postal Service or other interstate or foreign means of communication, such as telephone calls or use of the internet, to persuade or entice a minor (defined as under 18 throughout chapter) to be involved in a criminal sexual act. The act has to be illegal under state or federal law to be charged with a crime under 2422(b), and can even be applied to situations where both parties are within the same state, but uses an instant messenger program whose servers are in another state.[3]

{Chapter 117, 18 U.S.C. 2423(a)} forbids transporting a minor (defined as under 18) in interstate or foreign commerce with the intent of engaging in criminal sexual acts in which a person can be charged. This subsection is ambigious on its face, and only seems to apply if you transport a minor across state or international lines to a place where the conduct is already illegal to begin with. United States Department of Justice seems to agree with this interpretation.

{Chapter 117, 18 U.S.C. 2423(b)} forbids traveling in interstate or foreign commerce to engage in “illicit sexual conduct” with a minor. 2423(f) refers to Chapter 109A as its bright line for defining “illicit sexual conduct”, as for as non-commercial sexual activity is concerned. For the purposes of age of consent, the only provision applicable is {Chapter 109A, 18 U.S.C. 2243(a)}. 2243(a) refers to situations where such younger person is under the age of 16 years, has attained 12 years of age, and the older person is more than 4 years older than the 12-15 year old (persons under 12 are handled under 18 U.S.C. 2241(c) under aggravated sexual abuse). So, the age is 12 years if you’re within 4 years of the 12-15 year old’s age, 16 under all other circumstances. This most likely reflects Congressional intent to not unduly interfere with a state’s age of consent law, which would have been the case if the age was set to 18 under all circumstances. This law is also extraterritorial in nature to US Citizens and Residents who travel outside of the United States.

Where them servers at!

aNONOMISLY on September 30, 2006 at 09:07 am

Lewinsky wasn’t a child under the law, Robert108.  Please read more closely.

CV Rick on September 30, 2006 at 09:07 am

In DC, 16 isn’t a “little boy”. What part of that don’t you understand.  The Clinton mention just highlights the hypocrisy of the Dems here.  It goes farther: Clinton performed lewd sexual acts with his “little girl"(in your terms); he not only lied about it, but he refused to resign and turned the morals of the country upside down in order to save himself.  Foley has promptly resigned and has admitted what he did, which was to send IMs to this guy.  Actually, it’s not “you did it too”, it’s “Clinton did a lot more and got away with it.” Not so weak.  Republicans step up and do the right thing; Dems lie, deny and defend their criminal actions.  Big difference.

...a criminal sexual act.

Is sending salacious IMs a criminal sexual act?  Since the young man was clearly above the age of consent in both states, that is the only legal issue here.  Of course, he has resigned anyway, because Republicans have a much higher moral standard than do Dems.

Look r108, I’m going to spell this out for you just a little more before giving up.

the Age of Consent is not equivalent with the legal definition of Child.  While the age of consent is 16, a person is still a child until age 18 for legal matters.  The statute I copied in specifically refers to Child, not Age of Consent . . . that’s why I pointed that out.

Ankeney, 35, who was arrested Wednesday, is facing five counts of sexual assault on a child, three counts of sexual enticement of a child and one count of sexual exploitation of a child. The felonies, if he is convicted, could send him to prison for life.

Same thing with actual sex. If he had sex with someone that young who is over the age of consent, it ain’t against the law. Just...ugly. If he had sex with someone under the age of consent (which probably means some form of seduction was used) then he needs to be shot, pissed on, and dragged behind a car with signs stuck to him.

The difference betweem Clinton and Foley is that… Clinton was with an adult, though young, woman where Foley is playing around with underage little boys.

Not true.  They were young men over the age of consent, and there is no evidence of physical contact, unlike Clinton, who left some rather well-known evidence.  The differences here are not in Clinton’s favor.

If you don’t know by now, don’t mess with it.

Bill Clinton was the President of the USA. The highest held position in the country. An office that Americans focus on one man to be trusted to carry out the most important top business of our country. God bless our country!
