Libertarian Candidate Bob Barr Wins Texas By Default?

It would appear as though Libertarian Party candidate Bob Barr will win the state of Texas in the upcoming President candidate because the Democrats and the Republicans apparently failed to file the proper paperwork in the state to get their candidates on the ballot.

In a surprising development, it appears that scrappy little Libertarian Party candidate Bob Barr may have essentially won the presidential election in Texas by default. It seems that the two major parties failed to file their candidate selections with the Secretary of State by the statutory deadline, with the result that by law they cannot appear on the ballot, even as write-ins. In a press release on Wednesday Barr’s campaign manager, Russell Verney said: “Unless the state of Texas violates its own election laws, Congressman Barr will be the only presidential candidate on the ballot…Texas law makes no exceptions for missing deadlines.”

The Barr campaign’s press release on the apparent snafu is here.  Is this true?  Who knows.  Bob Barr, and the Libertarian Party (a nutty organization not to be confused with actual libertarianism), aren’t exactly sound and objective sources for information.  But if it is true…what a blunder.

Texas has 34 electoral votes, the second most in the nation, and is as reliably Republican as they come (those electoral votes went to Republicans in each of the last four Presidential elections).  Basically, Texas offsets the reliably liberal electoral college votes from California.

If McCain doesn’t have Texas he’s in big, big trouble.

Of course, this could just be a feint from the Barr campaign which is trying to get headlines.  The Republican and Democrat conventions were held late this year, and the Secretary of State in Texas doesn’t have to certify candidate filings until eight days after the deadline, so I’m guessing both Obama and McCain will be on the ticket in Texas.

But you have to wonder why the parties cut it so close like this.

It’s all political bullshit. Liberals (and Robert108) lie and spin and twist and obscure and distract and cheat to protect their guys and hurt the opposing team. It’s like wrestling. They distract the ref while their team mate hits you with a chair. There’s no rule they won’t break, no law they won’t skirt, no crime they won’t forgive as long as they can win.

Bob Barr is a Republican moonlighting as a Libertarian. Not to be confused with other Libertarians, he has recently voted against legal marijuana and same sex marriage. Steve Colbert (the only credible news source anymore, lets face it) introduced him as, “the guy who wants government to be so small that it fits in your bedroom.”

Well, I was going to call this bunk and was looking for some supporting evidence, but it doesn’t look good.  Bob Barr is at least half right, the deadline has passed.  (The parties must file before 5:00PM on the 70th day before the general election.  We are currently at 67 days before the election.)  As for if they actually filed or not, I can not find anything on that, even at the Secretary of State’s web site.

I’m confused as to what some of the commentors here think is bunk. First off, the lawsuit is real, so that is definitely not bunk. Also the law says what the law says. I’ve seen the filing for the lawsuit and the election filings made by the Democrats and the Republicans. I’m not a judge or legal scholar, but there are some questions that need to be answered regarding those filings. After all, even if they were filed on or before the deadline, they were filed before the candidates were selected by their respective parties, so even if they technically complied with Texas law, their ethics are called into question because they may have violated party rules.
