Latest Palin Smear: Sarah Is Stupid Because She Can’t Recite Supreme Court Cases From Memory

Of concern to McCain’s campaign, however, is a remaining and still-undisclosed clip from Palin’s interview with Couric last week that has the political world buzzing.
The Palin aide, after first noting how “infuriating” it was for CBS to purportedly leak word about the gaffe, revealed that it came in response to a question about Supreme Court decisions.
After noting Roe vs. Wade, Palin was apparently unable to discuss any major court cases.
There was no verbal fumbling with this particular question as there was with some others, the aide said, but rather silence.

This is apparently one of those “embarrassing” Palin clips CBS has been sitting on.
Obviously, one would like a political leader to be familiar with the major Supreme Court rulings. Hamden. Marbury vs. Madison. DC vs. Heller. Kelo. Etc. And I’m confident that Palin is undoubtedly familiar with a lot of the major SCOTUS cases, but just because she doesn’t immediately spew forth a list of them when the question is popped on her in the midst of an interview is hardly commentary on her judicial knowledge.
Think about it. Has anyone ever surprised you with a question about something you know but suddenly forgot? Someone once asked me how old I was and I had to stop and think about it for a minute. Now combine that perfectly human tendency with a high-pressure interview with someone you know is trying to trip you up and Palin’s brain freeze suddenly doesn’t seem all that unreasonable.
If you think being President means being able to immediately run down a list of prominent SCOTUS rulings the moment Katie Couric demands it then no, Sarah Palin isn’t ready to lead. But the reality is that that sitting in the Oval Office and making decisions is a much different thing than dealing with heckling journalists determined to make you look stupid.

    Often times when you want to hire a specific person, but are forced to open the position for application, the trick is to make the requirements so specific that only the person you originally wanted is hired. You see this in city and county hiring all the time.

    The media is trying to do the same thing here. Setting the ability to rattle off case law as a requirement for the job serves to make the ticket with more lawyers appear more qualified.

    This is a completely false set of qualification since the job of president is an administrative one, and lawyers usually don’t administer

    What I find most revealing is while Couric releases these clips in an effort to make Sarah look stupid, this crackerjack journalist with her “gotcha” questions to Sarah, didn’t even know FDR wasn’t president in 1929 and that American’s didn’t have TV’s.

    Joe Biden not only named the wrong president during the 1929 stock market crash, he also claimed a president who wasn’t president during the stock market crash went on TV before Americans had TVs.

    Couric was nearly moved to tears by the brilliance of Biden’s brain-damaged remark.

    …so really, who’s the stupid one here?

    If Palin says that she personally doesn’t approve of abortion, that’s fine. If Palin says that Roe v. Wade was judicial acitivism, she had better be ready to back that assertion with caselaw. Otherwise don’t comment on legal theory.

    Anytime a judge finds a word in the constitution that our Founding Fathers didn’t put there, it’s judicial activism. Like the word privacy.

    And using case law to defend a principle is stupid. The way our courts work, once the Supreme court rules, that’s the law. Any case law will just build on the original ruling, even if that ruling totally circumvents the constitution. Lots of case law clearly ignores the constitution and laws. The recent ruling in favor of Guantanimo detainees was unconstitutional and illegal. Congress has the ability to limit what the court can hear. And Congress said the courts can’t hear Guantanimo cases. Yet they did anyway.

    You won’t learn any of that by reading case law. Case law is important, but a lot of law students don’t read the actual LAWS anymore.

    Ummmm….how to respond to that. If it’s a made up law, and it is, no “case law” is needed. Any case law is further going to cement the original bad decision. The case itself was awful. Even pro-choicers don’t pretend it was good law. “Eminations and penumbras” is jumble speak for “we’re just making up the law as we go”.
