Is The North Dakota US Attorney Appointment Hinging On The Fargo Ticket Class Action Suit?
Months after former US Attorney Drew Wrigley stepped down, and after multiple public airings of frustration from Senator Byron Dorgan about the matter, North Dakota still doesn’t have a new US Attorney appointment.
I’ve posted several times before about an apparently battle going on between backers of ND Democrat money man and trial lawyer Tim Purdon and backers of current assistant US Attorney Jan Morley (who would be the state’s first female and Native American US Attorney). But one would think that a stand off like that would only delay things so long.
So what gives? Where’s the appointment?
Well here’s some speculation for you. If the pick is Purdon, could the delay have something to do with the Fargo traffic ticket class action lawsuit? After all, Purdon is one of the lawyers representing the class in that case and his firm stands to profit hundreds of thousands of dollars from it:
The Class Representative Plaintiffs in this action are Stephanie Sauby and James Burns (hereafter “Plaintiffs”). The Plaintiffs are represented by Timothy Q. Purdon, Monte L. Rogneby, Mark A. Friese, and Robert B. Stock, Vogel Law Firm, 200 North Third Street, P.O. Box 2097, Bismarck, North Dakota 58502-2097 (hereinafter “Class Counsel”).
“Counsel for the Class will seek Attorneys’ Fees and Costs of up to $350,000.00 from the City of Fargo. The City of Fargo will not oppose any claim by Class Counsel for Attorneys’ Fees and Costs that is less than $350,000.00. The Court will determine the amount of Attorneys’ Fees and costs which will be awarded.”
Are we waiting for Purdon to get his cut out of that lawsuit before we get a new US Attorney?
It’s a plausible explanation as any for this rather absurd delay.
