Dems Aren’t Considering Tort Reform On Health Care Because They Don’t Want To Make The Lawyers Mad

A moment of truth from an unlikely source: Howard Dean.

This is the answer from a doctor and a politician,” said Dean. “Here is why tort reform is not in the bill. When you go to pass a really enormous bill like that the more stuff you put in, the more enemies you make, right? And the reason why tort reform is not in the bill is because the people who wrote it did not want to take on the trial lawyers in addition to everybody else they were taking on, and that is the plain and simple truth. Now, that’s the truth.

Ed Morrissey responds:

Yes, that is the truth. Instead of taking on trial lawyers in an honest attempt to lower actual costs, the Democrats have decided to demonize insurers — who have incentives in place to keep costs low — and doctors.
Well, the first rule of politics is knowing which side your bread is buttered on.

Of course, if you really want to lower the cost of almost everything, get the govt out of the marketplace. Right now, 45% of the healthcare industry is controlled by govt, with the commensurate escalation of costs of operation to meet govt regulations.

I'm sure having two shysters living in the White House has nothing to do with it.<img src='http://i35.tinypic.com/2rwu8hs.jpg'>

When you see how much money trial lawyers and such groups give to the democrats, you can why they are afraid.

  • HG

How convenient for the democrats. They won't take on the laywers but the will take on the majority of Americans. Yeah, that sounds about like a liberal.

  • SigFan

Considering how many of the dems are lawyers is this a surprise? What a bunch of chicken-shit bozo's!

Funny how clearly Dean can speak with both feet in his mouth isn't it? Seems he's done that a few times if memory serves.

    Yeeehahhh!

Typical bully's mentality – why fight someone who can punch back?

Not much of a shocker there they are in bed with the Trial lawyers.

  • DINO

Why don't one of you brilliant shitstains find a report (legitimate) that gives us an idea how much malpractice costs the system?

So then your answer to escalating costs is to remove peoples' rights to due process?

Why stop there? Any normal (read "non-stem") knows that people suing doctors and business is nothing. The real cause of our legal morass is businesses suing businesses at the rate of around one suit filed every 11 seconds. Yes, your friends the capitalists never tire of suing each other over even the most petty things.

But you only want to stop people from settling their differences in the courts.

Once again you miscreants support taking power away from those with the least.

    SICKENING.

  • JFH

Any normal (read "non-stem") knows that people suing doctors and business is nothing.

NOTHING?! Um, tell that to the OB/GYNs that are fleeing states with loose tort rules. The rest of your paragraph shows a gross ignorance of the state of torts in the US. Companies suing other companies are usually about contractual disagreement, and rarely involve the punitive damages that occur in many health care cases…

You really haven't a clue what you're talking about, do you DINO?

  • DINO

Hey stupid fuck, why don't you tell us what tort reform has done for Texas?

So tell us about those ObGyns. Tell us why they pay such high rates. Is it lawsuits or the potential for lawsuits and fuck ups? How many suits are successful? How many dismissed?

Why don't you shitstains advocate for malpractice insurance rate reform?

Do you want your rights to due process taken away? Of course you don't, you just want others' taken away.

    So post some facts, shitstain.

OK! Now, that's the truth. Hopefully, everything will change for the better!

Dino's getting desparate. All he has anymore is insults.

Texas??? According to the October 2008 issue of Medical Liability Monitor, Texas voters

    bypassed the courts in 2003…

approving a state constitutional amendment that allows the state legislature to set a cap on non-economic medical liability damages. That cap was set at $250,000. Since then, Texas has shown a

sizable drop in medical professional liability rates

and medical license applications in Texas

have soared since the cap on noneconomic damages has been put in place.

  • DINO

Yet Texas remains the state with the highest spending on health care per capita and has the highest percentage of uninsured citizens.

Texas remains the state with the highest spending on health care per capita and has the highest percentage of uninsured citizens.

    What's your point, Swish?

The spending argument is a non-starter ever since the Dems' own CBO reported that ObamaCare wasn't going to save money as had been claimed repeatedly.

As for those uninsured, I'm wondering if those are all "citizens" as you've claimed, or more likely residents, many of whom really Mexican citizens.

  • DINO

The point is, despite the tort reform and the supposed number of doctors flocking to Texas:

Texas remains the state with the highest spending on health care per capita and has the highest percentage of uninsured citizens.

  • robert108

Only an uneducated moron like little stem would babble about cost without also discussing the value received.
    Typical Marxist thinking.

    What's your point, Swish?

My, my! A person with your self advertised intelligence missed the point?
Methinks you are simply obfuscating….changing the subject.

  • robert108

What's your point, little e? Is this that example of "civil debate" you can't seem to offer? Or are you just doing your usual no-content sniping?

  • tothestars2

I think I'm having a funny feeling run up my leg. A democrat that told the TRUTH! Out of body experience? Flashback from the acid days? There may be hope for the dems yet.
