Could Doug Hoffman Still Win In New York 23?

He’s conceded, and Democrat Bill Owens has already been sworn in (and already managed to break his campaign promises on the public option), but it looks like vote miscounts could have the race in question yet and hinging on absentee ballots:

Washington — Conservative Doug Hoffman conceded the race in the 23rd Congressional District last week after receiving two pieces of grim news for his campaign: He was down 5,335 votes with 93 percent of the vote counted on election night, and he had barely won his stronghold in Oswego County.
As it turns out, neither was true.
But Hoffman’s concession — based on snafus in Oswego County and elsewhere that left his vote undercounted — set off a chain of events that echoed all the way to Washington, D.C., and helped secure passage of a historic health care reform bill.
Democratic Rep. Bill Owens was quickly sworn into office on Friday, a day before the rare weekend vote in the House of Representatives. His support sealed his party’s narrow victory on the health care legislation.
Now a recanvassing in the 11-county district shows that Owens’ lead has narrowed to 3,026 votes over Hoffman, 66,698 to 63,672, according to the latest unofficial results from the state Board of Elections.
In Oswego County, where Hoffman was reported to lead by only 500 votes with 93 percent of the vote counted election night, inspectors found Hoffman actually won by 1,748 votes — 12,748 to 11,000.
The new vote totals mean the race will be decided by absentee ballots, of which about 10,200 were distributed, said John Conklin, communications director for the state Board of Elections.

So, if his competitor is already sworn in and has voted, what happens if it turns out he wasn’t the winner?
Lots and lots of lawsuits, I’d imagine.
It’s still a longshot for Hoffman to win, but it’s a little amazing to me that his competitor could be sworn in with the race still in doubt however marginal.

    The Dem/Libs must have really been worried about NY-23. The initially had 2 candidates running for the seat, Voting machine glitches and not wanting to count absentee and military ballots. Sounds like the standard template used by the left to steal elections. They learned their lessons after Florida 2000. Now they will cheat enough to win. Good ole Chicago style politics.

    I think it’s likely that a win would give Hoffman a leg up next year even if he doesn’t challenge the election.

    I don’t understand why politicians are in such an hurry to concede. I suppose it’s coming from pressure from the press who want to report things asap.

    Here are the most up-to-date unofficial results. There are still about 5,400 absentee ballots left to be counted.

    …Absentee ballots from military personnel that arrive at local boards of elections by Monday will still be counted, provided they were postmarked on or before Election Day. But Mr. Eaton said the trickle of ballots to the Jefferson elections office has dried up. The county has the district’s largest military population because of Fort Drum. The elections office sent out 605 absentee ballots to military, but only 51 have returned so far.

    Seeing as he got the majority of the vote I’ll say never. He ain’t a Democrat, like Scozafuzza, so no, he will never win, no matter that he received the majority of the ballots cast.

    Most (all?) of the absentees were cast before the gop quit the race.
    In a gop district, I imagine the majority of those votes went gop.

    Most of the absentee ballots are likely for the republican Scoffaza.
    Hoffman was only on the ballot for a few days so don’t expect a lot of mailed paper ballots for him.

    It’s up to the state (think Burris). So if Hoffman actually won, then Owens is not legitimate. I would be a procedural matter in the HoR, someone could challenge the vote but only the one, Hoffman would not be able to register one since the vote is closed.

    You would need to look at NY law but I suspect it would be a challenge seeking to invalidate the elections decision, assuming there was an official certified vote by the appropriate state official. That undoes Owens, and Hoffman is then replaced, new swearing in, no big deal.

    If Owens challenged, wouldn’t have a leg to stand on since it’s all in the laws and a matter of constitutional procedure

    Well that was the hang up in getting Burris in the senate. The ag wouldn’t sign off. Did the ag sign off in new York?

    If the absentee ballots break the right way the legal battle could last until the next election.

    I don’t know how it works in NY, but the AG has to certify the votes and that allows him to goto Washington. After that it’s up in the air. Usually you don’t certify until all the votes are counted. I swear I heard that before.

    It’s a probable but not likely. They shouldn’t have sworn in the new candidate. This could be a huge mess. My guess they say that he doesn’t vote the health care mandate gets passed with/without his vote.

    Still would be nice to see what pelosi would say after declaring election day a victory for her socialism. I’m guessing she would look sad if her face allows it.

    I don’t think it very likely that Hoffman will win. In a small district, 5000 votes is a pretty large margain to overcome. And that means the absentee ballots would have to go in a completely different direction than the normal vote, which is EXTREMELY rare.
