Bill To Allow Concealed Carry On Campus Gets “Do Pass” Nod From Comittee

But the text of the legislation was badly gutted, turning the bill into one that would allow concealed carry on campus in general to a bill that merely allows guns (not necessarily concealed) in student apartments (not even dorms by my reading) and the parking areas of those apartments.
Here’s the pertinent part of the bill as it reads now. The changes and status of the bill are supposed to be posted here, but whoever runs the state computer system is woefully slow at getting things updated.

3. This section does not apply to an individual licensed to carry a firearm under section 62.1-04-03 when that individual is on the real property comprising a state or private institution of higher education and that individual is on real property that is a dwelling unit or that unit’s related parking and shared space. In addition, this section does not apply to an individual with a valid general game license issued by this state or who has successfully completed hunter education in this state or any other state or province, when that individual is on the real property, comprising a state or private institution of higher education and that individual is on the real property that is a dwelling unit or that unit’s related parking and shared space. As used in this subsection, dwelling unit does not include a dormitory.

The passage of this still would still be a victory of sorts as campus leadership across the state has banned guns in student apartments. In fact, it was the banning of guns in student apartments that prompted the movement behind this bill in the first place.
I imagine that opponents to this bill (namely, the State Board of Higher Education) think that by throwing gun rights supporters this bone they will appease them without really giving them a victory. But word I’m hearing from supporters is that they’re not going to take this gutting of the bill laying down.
Nor should they, for the fight here isn’t over leveraging some new privilege to possess and carry firearms out of the powers that be. The fight here is about re-establishing gun rights as actual rights per the second amendment. Something that can’t be denied we citizens on a mere administrative whim.

No, it was not the banning of guns in campus housing that got this bill going in the first place. Our local media wants everyone to believe this was all about campus carry, but I personally asked this bill to be introduced as I have the last several sessions. I want to expand the places we can legally carry in ND and maintain our rights.

Yes, the public gathering exception for CCW holders got removed. Like I said, they gutted the bill. At present it only provides for college students to have guns in their on campus apartments or in their parking space (presumably in their cars), but not residence halls or dormitories as the bill calls them.

However this is still a step forward and there is a hope we can fix it in the senate. Please urge for a do pass on this from your representatives.

BTW, the state computer system finally has it updated as of about 10:00PM this evening.

I am hoping we can get this straightened out in the Senate. Please call your reps and ask them to pass the amended bill. It still is an improvement, but restoring most if not all of the exceptions would be a huge improvement. I have info at THR.org

I was pretty disappointed when I was finally able to read the amended bill this evening.

Geez, if it is truly concealed no one will ever know they have it (unless they are stupid enough to walk through a metal detector). I have taken my concealed weapon to forbidden places without any problems.

Personally I don’t know how they can ban someone from carrying with the CWP if they are walking down university ave.

Maybe someone needs to read the state constitution to these people.

    Geez.

The Constitution has been my permit for years.

The Left has been into civil disobedience since they first started smoking dope, burning bras and blowing up buildings.

Look it me, I’m exercising my Constitutional Rights.

    What a criminal, hey?

Ok, who speaks legaleeze? Did the public gathering provision get removed? CCW holders should know what I’m talking about here.

Yeah, Whistler, it is amazing how the state constitution can be essentially ignored.
