Aren’t Little Democrats Cute When They’re Indicted

Image and video hosting by TinyPic

Indicted!

-A Tennessee man has been indicted for hacking into the e-mail account of Republican vice presidential candidate Sarah Palin. David Kernell, 20, was charged with illegally accessing Palin’s Yahoo! account “by researching and correctly answering a series of personal security questions,” according to an indictment filed in U.S. District Court in Knoxville. ... If convicted of the felony charge, Kernell, an economics major at the University of Tennessee, faces a maximum of five years in prison and a $250,000 fine. Kernell, whose father is a Democratic state representative in Tennessee, turned himself in this morning to law enforcement authorities and is scheduled to be arraigned later today.

If you want to read the indictment follow the link to The Smoking Gun.

As Robert Blake said, if you can’t do the time then don’t do the crime.  I wonder if he learned this attitude from his father.  If so I can only imagine that the senior Kernell, a Democrat politician is proud of himself.

And of course he has only been indicted, not convicted.  So we don’t know for sure that he’s the guilty party.

Comments

Potential 1/4 million dollar fine and 8 years of state supervision. That’s pretty light considering what the party has in mind for the rest of us that don’t fall in line!

If he did it, he should get the maximum, pay every last cent and serve every last day of the sentence.  Cyberstalking threatens us all, and when we catch one of those scum, they should be prominently prosecuted and sentenced.

Five years prison for something like this is a bit steep.

I was thinking a ten figure fine and three years probation. Additional punishment as severe as not being able to use a computer for so many months or years.

At age 24, he’ll be in this mess under probation and with a felony on his record. He’s already facing a shitty future.

Nah, if you’re going to let him off that easy, make it 30 days cleaning out the port-a-potties with a coffee can along road constructions sites about 2 weeks after the construction crew starts complaining about the stench.

It is possible.  Because certainly we know Sarah Palins little daughter learned how to be easy with her sexual offers with men.

I wonder if she learned her irresponsibility from her mother?

No, he should get what any citizen of the US should get when committing such a crime IF FOUND GUILTY.

Right now he is indicted not convicted of such.

It should not matter his social status or who his friends / or family is, but I have a feeling he will get a much less sentence, probably probation and a fine, and not what everyone here hopes.

Most likely the judge will see the father as a democratic state rep, and if this is the first time, will give him nothing more than a slap on the wrist (probation and fine).

I highly doubt this kid will see the inside of a jail cell.

I am not comparing her irresponsible behavior to this kid. I am comparing Palin’s responsibility to this kids father.

When I speak about this young woman and her situation.  I clearly state you can’t be on both sides of the argument. Either she is a child or she is an adult.  Which is it?

That is nuts my friend.  Your logic for sentencing has no basis in how the American justice system works.

We have to know about his record.  If it is clean, he will get a slap on the wrist.  Cyber crime, weather you know it or not, is not a serious crime if it is not based on economic fraud.

He will get in trouble for violating privacy agreements, cyber fraud class c felony (it’s not malicious) and possibly soliciting of private property.

At most he will get 3-6 months, a fine and tons of probation.  Out in 4 weeks.

I don’t think you should even think about going there! I was not happy she chose to get married and have a family so young, she has an i.q.of 167, and was sent her h.s. yrs. to a $35,000 a yr. boarding school, and given every opportunity. However, that being said, she is a fantastic mother, raises her own children, goes to college p/t and works a few days a week. As for this little punk, he should get enough punishment in order to enable him to understand he seriously wronged someone. I also have a 19 yr. old son and would demand he was punished. I am questioning Sarah Palin’s influence, just as Whistler is questioning this kids fathers influence.  So your “kicked a girl” theory is just bogus bullshit.

OK, let’s look at Palin’s influence. The girl is engaged, and seems to have been engaged before the pregnancy. She’s already in a committed relationship. She decides to have sex with the man she loves and gets pregnant. Instead of having an abortion, she decides to keep the child, and the family still loves her and continues to accept her fiancee into the Palin bunch.

Even accepting that the sex was irresponsible, she did the right thing afterwards. If anything, this speaks highly of the Palin’s influence on their daughter. No parent can prevent their child from having sex, especially when they get engaged and are over the legal limit (16 in Alaska). But instead of taking the easy way out, the girl has taken responsibility. This is what should happen.

How is this comparable to a college student committing a crime? Sex is something we’re all to expect at some point, hacking’s not ever acceptable. Bristol jumped the gun a tad, this boy did a constant no-no.

What this idiot did was wrong - and a felony.

That being said, I’m having a hard time seeing a 20 year old go to a federal prison for it. A hefty fine, probation, maybe some limited jail time (couple of weeks, a month).

Don’t forget that if he’s convicted he’ll also have a federal conviction on his record for the rest of his life. The impact of that is HUGE.

Will he be convicted? Probably. The feds don’t usually indict until they have all their ducks in a row.

Nicely stated Di

he couldn’t find anything in the e-mails like “they” were expecting?

Not sure how to take that one, was he using a ‘royal we?’ ‘Our side as anointed by God will rake the mud!’ or was it more sinister ‘Daddy asked for some help on a project.’ I figure the elitist version.

FlyOnTheWall on October 9, 2008 at 09:37 am

Di

Bristol Palin made a moral decision, this guy committed a crime.

I don’t know if you know it or not, but they are both moral decisions.  Committing sin is no difference in the eyes of God if it is a crime or not.  Yes or no?

So when you are judging someone morally, there is no difference.

I have a 20 yr. old daughter with a 2 1/2 yr. old son, and a 8 mo. old daughter. Are you suggesting that it is my fault or that I was slutty because she got pregnant {and married} so young???

What I am suggesting is the same thing Whislter is suggesting.  The parents are either an influence on their child’s immoral behavior or they are not.

Personally, I don’t think either was influenced by their parents.  But if Whister is dumb enough to make that argument then he better be smart enough to realize that his argument works both ways.  I am demonstrating the idiocy of his logic.

Don’t take this personal, I was talking about Palin.  I have no knowledge of your actions when you were young.

No, he did not “hack into her PC”.  He hacked into the email account that she used that was hosted by an ISP.  Her email is sitting on some server in some data center far removed from her personal PC.  You are way off base here Zsa.

This is not a small crime.

Hacking into someone’s hosted email account IS a small thing in the cyber crime arena.  Trust me.  FBI agents identify that 13 yr old kids hack into larger corporations systems.  Do you know what the FBI does to those kids?  They threaten them with jail time unless they tech the FBI cyber crime unit how they did it.  Then they let them off.

Do you know what used to happen to the best hackers that hacked into government servers?  They got jobs after they got warnings.  Hacking used to be a badge of honor because it wasn’t usually malicious, it was usually a statement.  You guys just don’t know what you are talking about.

Now, today, cyber crime is different because today hackers are malicious and they choose to remain anonymous when they hack into government databases or servers, because, why?  Because they are malicious these days.

.. try to make an equivalence between felonious invasion of privacy and a teenage girl becoming pregnant before she and her fiance get married.

I hate to bust your bubble Robert but everyone knows there was no intent for the children to get married prior to Palins run for VP.

Sarah forced her child to get married for her selfish political ambitions.

1,000.00 bucks says that he never gets charged with that accusation you made up.

You don’t know how the legal system works friend.  Even if that was true, and it isn’t, no judge in the land could use that as justification for determining a sentence.  That is not how the American justice system works.

Another lie from you.  You still can’t stay on topic, I see.
This thread is about the fact that we caught the felon who violated Sarah’s privacy, for the purposes of influencing an election.
You are getting increasingly desperate with every off-topic comment.

It is such a hoot when the left preaches morality when they think it fits their argument.

Hannitized says: I don’t know if you know it or not, but they are both moral decisions.  Committing sin is no difference in the eyes of God if it is a crime or not.  Yes or no?

So when you are judging someone morally, there is no difference.

Then they totally forget their lack of morality of their “Messiah.”

So, what are we to make of Obama’s votes against protecting the right to life for living babies who have survived attempted abortions? Such babies are sometimes born alive as a result of late-term induced labor abortions, often sought when babies are believed (sometimes in error) to have genetic defects such as Down syndrome.

Earlier this decade, such living, breathing, babies who survived labor were “shelved” - left to die and disposed of with other medical waste, or were “aborted” - killed outside the womb. The practice was ultimately banned by unanimous Congressional votes, as even the most pro-abortion Senate Democrats - including every defender of partial-birth abortion - recognized that killing these breathing babies is no longer abortion in any real sense. It crosses the line; it is infanticide. Yet, incredibly, Obama repeatedly worked to deny these living babies any right to life.

Wrong again; that’s what he did.  Of course, you could always come up with another reason why he, the son of a Dem politician, targeted Sarah for his felonious behavior.
Got anything?
Why her?  Why now?

H,

Th eyes of God is an irrelevant assertion, since I am sure He is able to make His own judgment about the behavior of all of us.  Besides, it is those of you on the Left who are constantly carping about injecting God and religion into matters of public policy.  Your doing so here would seem to be a pretty substantial leap in hypocrisy.

Finally, please explain how those of you of the party which nominated John Edwards for VP, and elected Bill Clinton President, both major league philanderers, should be so presumptuous as to lecture the rest of us about moral behavior.  Your sanctimony has a distinctly hollow ring to it.

I assume the point was to change the argument away from the young, thugish, heavy handed, faux morally superior, soon to be felon.  Claim equivalence for a non-crime then subject change to how awful the rethugs are?

Hacking into someone’s hosted email account IS a small thing

We’ll see how you feel when someone “hacks” the small lock on your personal property.
THere is no difference no matter how much the leftists want it to be.

Being as Republicans are the official party of closet homosexual pedafiles, I’m not sure they have the right to lecture on morals either.

It is such a hoot when the left preaches morality when they think it fits their argument.

What you fail to grasp, rightwing, is that I am holding you to your own standards.  So if you are the party of morals, then you have to abide by them.  The liberals are accused of being immoral.  Surely you know this.

So when we hold you to the standards you have set for yourself, there is no contradiction.

This, of course, is aside from the fact that there are indeed liberals who weigh morality and who have God in their lives.

The bottom line is right is right and wrong is wrong.  Then, you have the law.  See the difference?

Here is a hint.  It is not against the law to sleep with another mans wife, in some states, but it certainly is wrong.

No you’re not.  You are proving that you are too stupid to understand the difference between a teenager having sex and a twenty something committing a felony.

I’m not surprised at all of your ignorance.

What’s going to happen to US industry when the global warming extremists like John McCain double the price of electricity?  I would think all these factories will close and set up in countries where they aren’t scared of technology.

R,

Leaving aside the speciousness of your argument (and the fact that obviously those of us on/in the Right are also the more proper and effective users of language), you will find by actually reading the entire thread that it was one of your own self-styled “progressives” who tried to draw a moral equivalency between young Mr. Kernell’s felonious actions (that means he seriously broke the law!) and the entirely spurious moral question of Sarah Palin’s daughter’s pregnancy.

Since the question of sexual impropriety had been raised, the mention of John Edwards and Bill Clinton, well known Democrats, was entirely appropriate.  Homosexual behavior, overt or covert, hadn’t been raised til you stumbled in here.  The question at issue was one of legal culpability and punishment.

Still, I understand that y’all would wish to change the subject from the illegal actions of a Democrat officeholder’s son, and try to attack Sarah Palin backhandedly at the same time.  Problem is, you just won’t find the same level of stupidity here than you will at Kos, HuffPo or DU.  Sorry!

You guys are kicking a 20 year old kid.

Kid?  He’s a voter, able to wear the uniform of our nation, and a legal adult.

He knew exactly what he was doing.  He wanted to help destroy Governor Palin’s reputation and career.

He should, and will, pay the penalty.

On the other hand, efforts to tie his criminal activity to his father are specious and ill-advised.

What I am not surprised with is that in your world, you can’t see a difference between a kid hacking a single email account and a guy who may sleep with your wife.

If you had a choice, which would you rather have happen to you and your family?  Have a another man sleep with your wife (if it is legal is your state), have your daughter impregnated at 16.......or your hotmail account hacked?

Take you pick and then shut your gums.

Because we all know which one you would choose.  Don’t give me this false outrage over a hacked email account.  You use the word felony as if it made the situation worse.  It doesn’t.

Same question to you Bat.  If you had a choice between having your hotmail account hacked, or your daughter impregnated at 16.  Which would you choose?

You are right about one thing.  There is no moral equivalence between the two.  Having your daughter pregnant at 16 is a far more traumatic experience on the family and all of the lives involved than having an email hacked.

One of them is legal (in some states), one of them is not.  I submit to you that having your 16yr old daughter impregnated is a much more significant moral outrage.
