Al Jaeger Doesn’t Have His Yard Signs Down?

Remember earlier how I said some moron would probably start whining today about some yard signs or something because it’s against North Dakota law to have political advertising up on election day?

Well, call me prescient, because some moron just fulfilled my prediction.  I guess Al Jaeger, our Secretary of State and head-honcho when it comes to elections, doesn’t have his lawn signs down.  And that matters.  Because, you know, IT’S A CRIME TO HAVE YARD SIGNS UP ON ELECTION DAY!111!!

Honestly, of all the things to be worried about on election day, this twit’s got his panties in a bunch over yard signs.

You know what?  My yard signs are still up, both at home and at the office.  I’d like to see some cop or official tell me to take them down, but it ain’t gonna happen.  You know why?  Because the law that requires the ads and signs to be taken down is unconstitutional.  You know, the first amendment?  Free speech?

Guess that sort of thing doesn’t matter to desperate partisans looking to score petty political points.

Update: Ok, just a bit of a clarification here.  The house in the picture might not be Al Jaeger’s house.  See, according to ND state law it is the candidate’s responsibility to ensure that all campaign signs are down.  Even lawn signs.  So these are “Al Jaeger’s signs” in the sense that they’re promoting his campaign, but the house pictured isn’t necessarily Al’s.

Still, what a dumb law.  I have a Dwight Grotberg sign up in my yard right now.  I’m not taking it down because I think the law is stupid.  Is that Dwight’s fault?

No.

Update: Just heard from someone at Republican headquarters who spoke with Mr. Jaeger and told me that all the signs at the Jaeger home are down.  Either the home in the picture is not Jaeger’s (I still don’t know one way or another) or someone put signs back up at Jaeger’s house.  I’m guessing the former.

Basically, this blog post at Bismarck Dems is pretty much just an attempt to smear Jaeger and confuse voters on election day, all predicated on a stupid law that restricts our freedom of speech.  From the Democrat Chairman of District 35 Chad Nodland, no less.

Good.  It’s a stupid law, and if enough incumbants are hit with violations something will be done about it.

A little update, it turns out that the house pictured might not be Jaeger’s.  The wording on the post at Bismarck Dems is a little confusing.

They’re Jaeger’s signs, since the law makes candidates responsible for the yard signs, but that probably isn’t his house.

Hmm...I want to respond with so many things, but am unsure if I should dignify such a flimsy and nonsensical argument with any response. Dave, your argument manages to simultaneously 1)make next to no sense and 2)be completely beside the point.
Could it possibly be that people jaywalk because they also don’t agree with the laws concerning it? Nevertheless, disagreeing with and disregarding a singular law still does not make a person an anarchist. That settles it, Dave-I’m getting you a dictionary for Christmas.

Here’s the election law barring lawn signs, etc.:

16.1-10-06.Electioneeringonelectionday-Penalty. Any person asking, soliciting, or in any manner trying to induce or persuade, any voter on an election day to vote or refrain from voting for any candidate or the candidates or ticket of any political party or organization, or any
measure submitted to the people,is guilty of an infraction.  The display upon motor vehicles of
adhesive signs which are not readily removable and which promote the candidacy of any individual, any political party, or a vote upon any measure, and political advertisements promoting the candidacy of any individual, political party, or a vote upon any measure which are displayed on fixed permanent billboards, may not, however, be deemed a violation of this section.

To me that means bumper stickers and billboards are ok, but no other forms of political speech.  Which is why our in-state political talk shows don’t cover politics on election day, and why the television/radio ads, etc. stop.  And why the yard signs have to come down.

Hedger, too, still has a bunch of her little signs up throughout Fargo as of this afternoon.  Sorry, I didn’t have a camera with me, but if I can get a photo in a little bit I’ll post it.

Dumb law, but it still should be followed until the legislature gets rid of it.

Rob-Don’t know if I’ll have time to get photos (sorry!), but if anyone else in Fargo goes to the area around 42nd St & 32 Ave S you should see them (except now I suppose Hedger’s people will rush out and take them down).

Fun post!  Shocking that someone from that blog would be trying to smear someone over something so trite as yard signs.  I guess someone has too much time on his hands.  I laughed when I read it, and it kind of made my day.

I would like to know, if you don’t mind, have you or anyone else who might like to comment, gotten any of the so called ‘robo’ calls from democrats?  I don’t currently live in North Dakota, so I don’t know for sure.

I don’t see why the they should.  They can leave them up for all I care.  I just think it’s dumb to criticize anyone for having signs up.

Chris, I got one live person call from a Democrat two nights ago.  It was a young girl who asked me if I was voting.  Didn’t say who she was from or anything.  Just told me to vote (which I already had via absentee ballot at that point).

I kinda thought that was funny.  A non-partisan get out the vote effort in conservative ND isn’t going to help them very much.

I have always thought that those who lose elections should have to personnally drive around and remove all the political yard and roadside signs. Local, State, and Federal. Not hire people to do it, physically go out and do it themselves. With massive fines for non-compliance. F**king lawyer scum.

The ACLU could not be troubled though,
they are busy defending NAMBLA, and other sleazy groups who wish to destroy the notions of right and wrong in this country.  How could they be expected to actually do something good for society!
