A Constitutional Amendment To Save The Secret Ballot?
With enrollment on decline and high-profile PR debacles like the auto bailouts dragging them down, the number one issue for unions in this country is the horribly misnamed Employee Free Choice Act. Also known as “card check.” This bill would remove the requirement for a secret ballot in the labor organizing process. Currently, before a work force can be unionized, workers most vote for it in a secret balloting which protects them from the machinations of both the unions and the business management. If unions get their way, that secret ballot would cease to exist and a labor force would be unionized once the union organizers bully enough people into signing a card saying they want to organize.
Clearly, for those of us who believe in freedom and the sanctity of the democratic process, this is going to be a serious battle.
Today in my email inbox I got the following email from former House candidate Duane Sand indicating a movement in a number of states to amend their various constitutions to protect the sanctity of the secret ballot.
From the email:
We are going to collect 40,000+ signatures and pass a Constitutional Measure in North Dakota that protects secret ballots.
The ballot language is very simple: “To preserve and protect the fundamental right of individuals to vote by secret ballot, where local, state or federal law requires elections for public office or ballot measures, or requires designations or authorizations for employee representation, the right of individuals to vote by secret ballot shall be guaranteed.”
The 40,000 signature goal seems a bit lofty given that it only takes 26,000 signatures to put a constitutional measure on the ballot, but the movement itself is a worthy one.
After all, who can argue against workers being able to vote on unionization in a secret ballot?
The movement doesn’t seem to have a website as yet, but I’ll be sure to keep you readers up to date as news comes in.
