Reid: Appoint Another Miers!

Miers has withdrawn, and Harry Reid is pissed about it:

Washington, D.C. – Senate Democratic Leader Harry Reid released the following statement on Harriet Miers’ withdrawal of her nomination to the United States Supreme Court.

“The radical right wing of the Republican Party killed the Harriet Miers nomination. Apparently, Ms. Miers did not satisfy those who want to pack the Supreme Court with rigid ideologues.

“I had recommended that the President consider nominating Ms. Miers because I was impressed with her record of achievement as the managing partner of a major Texas law firm and the first woman president of the Texas Bar Association. In those roles she was a strong supporter of law firm diversity policies and a leader in promoting legal services for the poor. But these credentials are not good enough for the right wing: they want a nominee with a proven record of supporting their skewed goals.

“In choosing a replacement for Ms. Miers, President Bush should not reward the bad behavior of his right wing base. He should reject the demands of a few extremists and choose a justice who will protect the constitutional rights of all Americans."


Judging from this reaction I think it's safe to say that, with Miers' withdrawal, we just dodged a bullet. Either that or Reid is just setting up some bluster for whoever comes next.

Either way, Reid's invective here is a bit troubling. After all, why shouldn't we want a "rigid idealogue" sitting on the high court? As long as the ideology to which that person remains rigid is one that requires a strict adherence to the laws as written in the Constitution we don't have a problem.

You see, what Reid really wants is somebody sitting on the court who will get all sympathetic to the causes coming before the court and twist the law around to fit whatever feelings he or she has on the subject. But that's not how the SCOTUS is supposed to work. In this country, legislators write the laws. Judges apply what is written.

This isn't an extremist view, this is just reality.

Well..this is excellent. Now the president can nominate someone truly deserving of the title....Janice Rogers Brown.

If by skewed goals Reid is referring to a rigid constructionist and originalist, well, he’s right about me.

You keep using that word.  I do not think it means what you think it means.

An ideologue is a ”blindly partisan advocate.” Isn’t a judge supposed to be a fair and impartial fact finder, not an advocate?  Isn’t that the job of the attorney?

Well, perhaps I didn’t use the word exactly right.  What I was getting at was that I want a judge is a “blindly partisan advocate” in favor of the Constitution.  Somebody who will put the law, as it is written, above all other considerations.
