Sexless Sex Offense

Jeez...

Chicago Sun-Times - Fitzroy Barnaby said he had to swerve to avoid hitting the 14-year-old Des Plaines girl who walked in front of his car.

She said he yelled, "Come here, little girl," before getting out of his car and grabbing her by the arm.

He said he simply lectured her.

She said she broke free and ran, fearful of what he'd do next.

In a Thursday ruling, the Appellate Court of Illinois said the 28-year-old Evanston man must register as a sex offender.

While acknowledging it might be "unfair for [Barnaby] to suffer the stigmatization of being labeled a sex offender when his crime was not sexually motivated," the court said his actions are the type that are "often a precursor" to a child being abducted or molested.

Though Barnaby was acquitted of attempted kidnapping and child abduction charges stemming from the November 2002 incident, he was convicted of unlawful restraint of a minor -- which is a sex offense.

Some are using situations like the one described above as support against sex registries. I agree that such registries are worthless if people like Mr. Barnaby are placed on them. But they would be useful if officials applied a little common sense when defining who is and is not a sexual offender.

[...] The World Wide Rant calls it insanity. Ripclawe believes the problem is Chicago. Say Anything worries about sex offender registries. [...]

These registries are filled with useless information.  19 year olds who have had sex with their 17 year old girlfriends and now this guy.  This is the straw the broke the camel’s back for me.  I’m now against these registries.  It’s quite apparent that asking for a little bit of common sense is out of the question.  The data is corrupted and not to be trusted.

[...] I honestly can’t understand why we let high-risk perverts like Duncan go free when we’re convicting people like this guy for “sex” crimes that don’t even involve sex. [...]

I hear ya likwid, but I’m still not certain I’m ready to give up on registries.  I guess I’m still hoping for a even application of common sense.

From what we know about Joseph Duncan he certainly is the kind of fellow that most would be happy to lock up and throw away the key or something worse.  At this point, knowing what he did in Idaho and having read all of his weblog etc, I would be willing to pull the switch if they still used the electric chair.  However give some thought to the law or regulation that would have stopped him.  Keep in mind that any such law would apply to everyone.  1980 the 20 years he recieved was considered harsh.

[...] Providing better definitions for who is (and is not) a sex offender. Men who grab little girls by the arm after they run out in front of a car are not sex offenders and don’t deserve to be on this list. Neither do young adults who have sex with their “underage” girlfriend/boyfriend who is really just a year or so younger than them. [...]
